Procedural Posture

Criminal Review / High Court Review of Magistrate Court Conviction

  1. 1 Whether the conviction of the 1st accused for stock theft was supported by the evidence and findings of credibility
  2. 2 Whether the correct legal provision was applied to the 1st accused's conduct

Ratio Decidendi

The conviction of the 1st accused for stock theft was not supported by the evidence or the court's own findings of credibility. The 1st accused's version was corroborated, and there was no evidence he knew or should have suspected the property was stolen. The magistrate misapplied the law by convicting under s 114(2)(a) instead of considering s 114(2)(d), and even under the latter, a conviction was not tenable given the facts.

Court Disposition

Conviction of 1st accused set aside; acquittal entered; 2nd accused's conviction confirmed.

Orders

  • 1st accused found not guilty on all three counts of stock theft and acquitted.
  • 1st accused to be released from prison immediately; warrant of liberation issued.
