Ratio Decidendi

The common law rule granting the mother sole guardianship and custody of a child born out of wedlock, and denying the father parental power, is inconsistent with sections 56(1), 56(3), 81(1)(a), and 81(2) of the Constitution of Zimbabwe, 2013, as it constitutes unfair discrimination based on marital status and is not in the best interests of the child. Both parents are entitled to joint guardianship and custody, to be exercised in consultation and subject to the child's welfare.
