Civil Summary Judgment Application / Judgment on Opposed Application

  1. 1 Whether the applicants are entitled to summary judgment for eviction of the respondent from Ranch 1090 Hampshire Estate Wilshire, Chivhu
  2. 2 Whether the respondent has a bona fide defence to the eviction claim
  3. 3 Whether the summons have lapsed under Practice Directive No. 1 of 2022

Ratio Decidendi

Applicants have established clear title and real rights to the farm. Respondent failed to provide a valid agreement of sale or plausible defence. Deposits into the AFC account do not amount to a defence for eviction. The point in limine on lapse of summons is dismissed as proceedings were delayed due to the respondent's failure to appoint an executor. The pending case HC 7045/22 does not bar the present eviction proceedings as the causes of action differ.
