Ratio Decidendi

The applicable law at the time of Wilson Muchiyani Mudawini's death (pre-1 November 1997) did not permit a widow to inherit immovable property under customary law. The Montgomery Plot was properly administered and sold by the rightful heir's instruction, with no evidence of fraud or undervaluation. No valid claim for improvements was lodged. The 5th and 6th defendants, as registered owners, are entitled to eviction of the plaintiffs.
