Ratio Decidendi

The respondent repudiated his contract of employment with the appellant by accepting employment with Zimnat on 1 September 1997. Therefore, he is only entitled to arrears of salary and benefits from the date of dismissal (21 February 1996) to the date he took up employment with Zimnat (1 September 1997). The Tribunal erred in awarding damages beyond this period and in treating back-pay and damages as separate concepts.
