Procedural Posture

Civil Appeal / Supreme Court Judgment

  1. 1 Whether the court a quo erred in finding that the contracts of employment had been tacitly relocated

Ratio Decidendi

The Supreme Court held that the respondents' continued service and remuneration on the same terms after expiry of their fixed-term contracts constituted tacit relocation. There was no evidence of negotiations or communication of intent to change terms during the relevant period. The appellant's subsequent offer of new contracts did not negate the existence of a tacitly relocated contract. The lower court correctly applied the principle of tacit relocation, and the appeal was dismissed.
