Procedural Posture

Opposed Application / Judgment

  1. 1 Whether the use of 'VIMCO' infringes the registered trade mark 'VIM' under the Trade Marks Act [Chapter 26:04]
  2. 2 Whether the first respondent has passed off its product as that of the applicants
  3. 3 Whether the first respondent should be ordered to change its corporate name under section 24(13) of the Companies Act [Chapter 24:03]

Ratio Decidendi

The use of 'VIMCO' by the first respondent so nearly resembles the applicants' registered trade mark 'VIM' as to be likely to deceive or cause confusion, constituting infringement and passing off. The applicants have established goodwill and reputation in 'VIM'. The defences of prescription, waiver, and estoppel are not applicable. However, an order to change the corporate name is not warranted as the name is used for other products not in dispute.
