Ratio Decidendi

The respondent's introduction of new accreditation categories for journalists is ultra vires the Access to Information and Protection of Privacy Act and its regulations, as the law only provides for two categories (local and foreign journalists). The respondent cannot create new categories by press statement, and any such change must be made by legislative amendment. The requirements for an interim interdict are met as there is a reasonable apprehension of harm to the applicant's members, no adequate alternative remedy, and the balance of convenience favors the applicant.
