Nenhum candidato pode ser detido ou sujeito à prisão preventi- va, salvo em caso de flagrante delito por crime punível com pena de prisão, cujo limite máximo seja superior a três anos e, fora de flagrante delito, por crime punível com pena cujo limite máximo seja superior a oito anos de prisão.
