Power to remove or suspend members

1 Section 42 of the Crown Entities Act 2004 applies to any member of the Electoral Commission who is a Judge. 2 Section 39(1) of the Crown Entities Act 2004 does not apply to any member. 3 Instead, any member who is not a Judge may be removed for just cause by the Governor-General acting upon an address from the House of Representatives. 4 Just cause has the same meaning as in section 40 of the Crown Entities Act 2004 . 1988 No 2 s 6 Section 4G : inserted , on 22 May 2010 , by section 4 of the Electoral (Administration) Amendment Act 2010 (2010 No 26).
