Provision text
Official source(1) No member of Parliament may be
prosecuted, pursued, arrested, detained
or judged for his or her opinion
expressed or vote cast in the exercise of
his or her duties.
(2) No member of Parliament suspected of
a felony or misdemeanour may be
prosecuted or arrested without the
authorisation of the Chamber of which
he or she is a member by a two-thirds
majority vote of members present at the
sitting of the Plenary Assembly, unless
he or she is caught red-handedly
committing a felony or misdemeanour.
(3) In the case of a period outside the
ordinary session, an extraordinary
session is convened for this purpose.
(4) A member of Parliament definitively
convicted of a felony or misdemeanour
automatically loses his or her
parliamentary office.
(5) Each Chamber of Parliament through
the organic law determining its
functioning may provide for gross
misconduct which lead to the removal
from office of a member of that
Chamber upon approval of its members.
In that case, the decision for removal is
taken by a three-fifths majority vote of
members of the Chamber of Parliament
concerned.
