Executive Council : The Executive Council of the Emirate. Commander-in-Chief : The Commander-in-Chief of Abu Dhabi Police. Competent Authority : Abu Dhabi Police General Headquarters. Concerned Entity : The authority competent to issue economic licenses in the Emirate 5 Automated Alarm System : A device or set of devices and software that are used for alert and warning purposes in the event of any threats. Private Establishments : Establishments licensed by the Concerned Entity to practice commercial, industrial, craft, professional, agricultural, service or any other economic activities, and use an Automated Alarm System or an Information Program to protect and secure their services and properties. Information Programme : An electronic programme prepared by the Competent Authority to enter and organize data and information related to the activities and works of Private Establishments. Data : Inputs and raw facts, such as letters, words, numbers, symbols, diagrams, coordinates, (raw) images or signs, among many others. Information : Outputs and results extracted from data processing, after ensuring their conformity at their sources, then classifying, saving, transferring and using them when needed, particularly the writings, images, sounds, numbers, letters, symbols, signs and others. Service Provider : A natural or legal person authorised by the Competent Authority to provide technical solutions for the Information Programme, and to supply, install, provide or operate an Automated Warning System. Article 2 The provisions of this Law shall apply to Service Providers and Private Establishments in the Emirate. 6 Article (3) The Competent Authority shall have the following competencies: 1. Establish, organise, manage and develop an Automated Warning System and Information Programme. 2. Create a unified database for Service Providers and Private Establishments. 3. Issue the necessary approvals and permits for Service Providers and Private Establishments. 4. Ensure that Service Providers and Private Establishments complete the installation and operation of the Automated Warning System or Information Programme, in accordance with the conditions and controls set forth in this Law and its Executive Regulations. 5. Propose fees for services related to the Automated Warning System and the Information Programme, and submit them to the Executive Council for approval. 6. Specify the controls for the operation, update and maintenance of the Automated Alarm System, and determine its technical specifications. Article (4) The Service Provider shall commit to the following: 1. Not to engage in the activity of supplying, installing, presenting or operating an Automated Alarm System for Private Establishments, or provide technical solutions for the Information Programme without obtaining a permit from the Competent Authority, and in accordance with the conditions and controls specified by the Executive Regulations. 2. Comply with the activity specified therefore in the licence issued by the Concerned Entity. 3. Obtain permits issued by the Competent Authority for their employees to practice the activities aforesaid in Clause (1) of this Article, in accordance with the conditions and controls set by the Executive Regulations. 7 Article (5) Private Establishments shall commit to the following: 1. Instal the Automated Alarm System by the authorised Service Provider. 2. Turn on the Automated Alarm System at all times. 3. Maintain and update the Automated Alarm System on a regular basis, to ensure the sustainability, efficiency and conformity with technical specifications. 4. Notify the Competent Authority before changing the main office of the establishment. 5. Not to change or modify the technical specifications of the Automated Alarm System. 6. Linking electronically with the Information Programme, as determined by the Executive Regulations. Article (6) • Each of the Service Providers and Private Establishments shall commit to submit data, information and documents related to the Automated Alarm System and the Information Programme to the Competent Authority, in accordance withthe Executive Regulations. • All data, information and documents obtained shall be considered confidential, and may only be accessed by those concerned in the Competent Authority, and in accordance with the controls issued by a resolution of the Commander-in-Chief. • It is prohibited to copy, display, publish, send, circulate, use, destroy or transfer any data, information or documents from the Automated Alarm System or the Information Programme in any way to any party or person who is not legally authorised to view or possess them, except upon the approval of the Competent Authority or judicial authorities, as the case may be. 8 Article (7) Any natural or legal person who owns an establishment that is not subject to the provisions of this Law may apply for the service of installing an Automated Alarm System and make an electronic linkage to the information Programme, in accordance with the conditions and controls specified in the Executive Regulations. Article (8) • Without prejudice to any more severe penalty provided for by any other law, an administrative fine not exceeding AED (500,000) five hundred thousand Dirhams shall be imposed upon anyone who violates the provisions of this Law, its Executive Regulations, regulations, policies, resolutions and circulars issued in implementation thereof. • The Competent Authority shall be in charge of collecting the administrative fines, and the Commander-in-Chief shall, following the approval of the Executive Council, issue a schedule specifying the violations and administrative fines prescribed for each of them, provided they do not exceed the fine limit as stipulated in this Article. • The Commander-in-Chief or his authorised representative may offer reconciliation to the violator, provided that this is evidenced in the minutes of the proceedings, and the violator who accepts the reconciliation shall pay a fine equivalent to (75%) of the total administrative fine specified for the violation within a period not exceeding sixty days from the date of the reconciliation offered thereto. • In all cases, if the violator does not commit to removing the effects of the violation within the specified time, the Competent Authority shall remove them at the violator's expense. Article (9) • The Competent Authority may take any of the following administrative penalties: 1. Notice. 9 2. warning. 3. Temporarily suspend the activity in coordination with the Concerned Entity in accordance with the legislations in force. 4. Temporarily or permanently close the facility in coordination with the Concerned Entity in accordance with the legislations in force. • The Executive Regulations shall determine the procedures and controls for applying the administrative penalties aforesaid in this Article Article (10) • It is permissible to file a grievance against administrative penalties before the Competent Authority within (60) sixty days from the date of notifying the grievant thereof, and failure to decide upon the grievance during this period from the date of submission thereof shall be considered as a rejection. • The Executive Regulations of this Law shall determine the procedures for submitting grievances, as well as the mechanism and controls for deciding upon them. Article (11) • The Commander-in-Chief shall, following the approval of the Executive Council, shall issue the Executive Regulations of this Law. • The Commander-in-Chief shall issues the policies, resolutions, and circulars required for the implementation of the provisions of this Law. • The policies, regulations, bylaws, resolutions and circulars in force to this effect shall remain applicable in a manner that does not conflict with the provisions of this Law, until the issuance of the policies, regulations, bylaws, resolutions and circulars implementing its provisions. Article (12) Those who are subject of the provisions of this Law shall adjust their situation in accordance with its provisions within a period not exceeding three months from the date of its enforcement. 10 Article (13) • The aforesaid Law No. (2) of 2010 shall be repealed. • Any provision contrary to the provisions of this Law shall be repealed. Article (14) This Law shall be published in the Official Gazette and become effective three months from the date of its publication. (27) of 2019 concerning the Department of Finance; • Federal Law No. (2) of 2015 concerning the Commercial Companies, and its amendments; and • Based on what was presented to and approved by the Executive Council; Issued the following Resolution: Article (1) • The Department of Finance shall be delegated with the power to establish all types of companies on behalf of the Government of Abu Dhabi, and when established, these companies shall be wholly owned by the Government represented by the Department of Finance. • The Department of Finance may determine the legal form of these companies, their names, activities and objectives, issue and amend their memoranda of association and articles of association, and determine their capital and management, in accordance with the resolutions, controls, terms and conditions issued or determined by the Chairman of the Department of Finance. Article (2) The companies established by the Department of Finance in accordance 33 with the provisions of Article (1) of this Resolution, or any of its subsidiaries, shall not be subject to the provisions of the laws or regulations on contracts or procurement applicable in the Emirate of Abu Dhabi. The employees and workers of any of these companies shall not be subject to the human resources laws and regulations applicable in the Emirate. Only 60% of the employees, workers, and operators of the contracts of services and outsourcing may be present at the workplaces of the government entity or company. 2. The general absorptive capacity of the workplaces shall be respected while receiving visitors and customers, as prescribed in the standards of safety and physical distancing. 3. The “Manual of Procedures and Controls for Remote Work during Emergency Conditions” issued by the Human Resources Authority of the Emirate of Abu Dhabi shall be applied in addition to other relevant instructions. 4. The following categories shall work remotely: a. Employees above the age of 60 years old. b. Employees suffering from chronic diseases and weakened immune system, provided that a certified medical report is submitted and updated on a regular basis. c. Employees from among people with determination. d. Pregnant and breastfeeding women employees 44 e. One of the parents of a child in grade 10 and below learning from distance, provided that a letter from the educational institution is submitted proving that students are learning remotely. This shall remain valid until the end of the academic year 2020 – 2021. A certificate from the employer of the other parent shall be also submitted to prove that he is not working remotely for the education of the children. Second: Periodic tests for the Employees, Workers and Operators of the Services and Outsourcing Contracts at the Government Entities and Companies: 1. The employees, workers and operators of the service and outsourcing contracts who are present at the workplace and did not get vaccinated against Covid-19, shall take a PCR test every 7 days and the government entity or company shall not bear the cost of such tests. However, the persons holding a certified medical report proving that they are not eligible to get vaccinated against Covid-19 shall be exempt and the government entity or company shall bear the cost of the PCR tests. 2. The employees, workers and operators of the service and outsourcing contracts who are present at the workplace and got vaccinated against Covid-19, shall be subject to a PCR test once every month and the government entity or company shall not bear the cost of such tests. The persons who got vaccinated as part of the national vaccination programs and have an active “E” status and the volunteers for clinical studies having an active “gold star” status on the Al-Hosn app shall be exempt from the PCR tests. Third: Contacts of an Infected Person/ People Returning from Abroad, for the Employees and Workers of the Government Entities and Companies: The quarantine duration shall be calculated – as per the duration prescribed by the competent entities – for a contact of a person infected with Covid-19 or for a person returning from abroad as follows: 1. In case the employee got the two doses of the vaccination against Covid-19 or has a certified medical report proving that he is not eligible for the vaccination, then such employee shall be subject to the remote working system. 2. In case the employee was not vaccinated against Covid-19, then the quarantine duration shall be deducted from the annual leaves and in case 45 he does not have a leave balance, then this shall be considered as a leave without remuneration, and he shall not be subject to the remote working system. Fourth: Customers, Visitors, and Temporary Workers present at the Workplaces of the Government Entities and Companies: Ensure that the customers, visitors and other temporary workers who are not covered in Paragraph 2 of this Circular and present at the workplaces of the Government Entities or Companies have presented the negative results of a PCR test that is not older than (3) days. Fifth: Precautionary Measures Apply the occupational health and safety standards, manuals, and instructions, as well as physical distancing and precautionary and preventive health measures deemed necessary and issued by the competent entities to guarantee safety and physical distancing. Sixth: Periodic Reports Submit monthly reports to the Human Resources Authority of the Emirate of Abu Dhabi about the developments of the implementation of the provisions of this Circular. Seventh: This Circular shall become effective from 30/05/2021, and all other circulars and instructions issued in this regard shall remain in force in case they are not contrary to the provisions of this Circular.
