(2) of 1971 concerning the National Advisory Council, and its amendments; • Law no. (2) of 2000 concerning Civil Retirement Pensions and Benefits in the Emirate of Abu Dhabi, and its amendments; • Law no. (6) of 2016 concerning the Human Resources in the Emirate of Abu Dhabi, and its amendments; and • Based on what was presented to and approved by the Executive Council; Issued the following Law: Article (1) • The name “Abu Dhabi Retirement Pensions and Benefits Fund” shall be replaced by “Abu Dhabi Pension Fund” wherever mentioned in the aforesaid Law No. (2) of 2000 and any other legislation. • The definition of “Director” occurring in Article (2) of the aforesaid Law No. (2) of 2000 shall be repealed and replaced with the word “Director” and the word “Director-General” shall be replaced by the expression “Managing Director”, wherever mentioned in the aforesaid Law No. (2) of 2000. 5 Article 2 The Articles (3, 5, 9, 11) of the aforesaid Law No. (2) of 2000 shall be replaced by the following: Article 3: • The Fund shall be a public institution, having an independent legal entity. It shall have financial and administrative independence as well as full legal capacity to act. • The main office of the Fund shall be located in the city of Abu Dhabi and branches or offices thereof may be established inside or outside the Emirate by a decision of the Board. Article 5: • The management of the Fund shall be assumed by a board of directors, consisting of not less than five members and not more than nine, including the Chairman and Managing Director, who shall be appointed by virtue of a Chairman of the Executive Council Resolution. • The Chairman of the Board may select, from among its members, a Vice- Chairman to replace him during his absence. • The term of the Board's membership shall be three years, automatically renewable for similar periods unless a Resolution was issued by the Chairman of the Executive Council to reform the same. Article 9 The Board shall be the competent authority to manage the Fund’s affairs and supervise its tasks. It shall in particular assume the following: • Approve the draft budget, annual budgets and closing accounts of the Fund and its subsidiaries for every fiscal year. • Approve the annual report about the Fund’s activities. • Approve the general insurance policy of the Fund. • Approve the general investment policy of the Fund. 6 • Suggest the legislations related to the Fund’s competencies and submit them for approval according to the legislations in force. • Approve the general plan for the investment of the Fund’s assets and approve the fields of implementation thereof. • Approve the Fund’s organisational structure. • Issue the Fund’s internal financial, administrative, investment and operational regulations. • Appoint one external auditor or more for the Fund, from among the chartered auditors, provided that he submits his report to the Board within three months from the end of every fiscal year of the Fund. • Establish companies alone or in participation with third parties inside and outside the State, in implementation of its investment policies . • Suggest the Fund’s human resources’ policies and regulations and submit them to the Executive Council for approval. • Appoint experts, consultants and technicians on a temporary or permanent basis, determine their remuneration and seek the assistance of experts and consulting institutions and offices commensurate with the Fund’s needs and the achievement of its objectives. • Form permanent and temporary committees from among its members or others to carry out the tasks assigned to them. • Any other competencies or tasks assigned by the Executive Council. Article 11: • The Managing Director shall assume the management of the Fund. • One Director-General or more may be appointed by a resolution issued by the Executive Council, upon the suggestion of the Chairman, reporting to the Managing Director. The Board of Directors shall specify their competencies and financial remuneration according to the Fund’s organisational structure. 7 Article 3 A new Article shall be added under no. (14 bis) to the aforesaid Law No. (2) of 2000 to read as follows: Article (14 bis) The provisions of human resources and retirement laws and regulations in force in the Emirate shall apply to the Fund’s employees and users, where there is no rules in the human resources’ policies and regulations of the Fund. Article 4 Articles (101) and (102) of the aforesaid Law No. (2) of 2000 shall be repealed as well as any provision contrary to the provisions of this Law. Article 5 This Law shall be effective from the date of its issuance and published in the Official Gazette. Khalifa bin Zayed Al Nahyan Ruler of Abu Dhabi Issued by us in Abu Dhabi On: 14 April 2021 Corresponding to: 29 Shaban 1442 Hijri 8 Crown Prince Chairman of the Executive Council Resolutions 9 evitucexE eht fo namriahC ecnirP nworC snoituloseR licnuoC Chairman of the Executive Council Resolution No. (5) of 2021 Concerning the Amendment of Some Provisions of the Executive Regulations of Law No. (22) of 2005 concerning the Organisation of Hunting in the Emirate of Abu Dhabi We, Mohamed bin Zayed Al Nahyan, Crown Prince, Chairman of the Executive Council, Having reviewed: • Law No. (1) of 1974 concerning the Reorganisation of the Governmental Body in the Emirate of Abu Dhabi and its amendments; • Law No. (22) of 2005 concerning the organisation of hunting in the Emirate of Abu Dhabi; • Chairman of the Executive Council Resolution No. (69) of 2015 concerning the issuance of the Executive Regulations of Law No. (22) of 2005 concerning the Organisation of Hunting in the Emirate of Abu Dhabi, Issued the following Resolution: Article (1) A new clause shall be added under No. (7) to Article (4) of the aforesaid Chairman of the Executive Council Resolution No. (69) of 2015 to read as follows: “7- The Competent Authority may issue a licence for traditional hunting methods outside the Hunting Areas in accordance with the conditions and controls determined thereby.” Article (2) “Species Conservation Fee” shall be repealed wherever mentioned in the 11 aforesaid Chairman of the Executive Council Resolution No. (69) of 2015. Article (3) Any provision contrary to the provisions of this Resolution shall be repealed. Article (4) This Resolution shall be effective from the date of its issuance and published in the Official Gazette. Approval of the electronic birth notification method in addition to the method of notification stipulated in Article (6) of the aforesaid Chairman of the Executive Council Resolution No. (68) of 2008. 2. Abolition of the Births Committee formed pursuant to Article (19) of the aforesaid Chairman of the Executive Council Resolution No. (68) of 2008, and the transfer of all its functions to the Department. 3. Approval of the electronic death notification method in addition to the method of notification stipulated in Article (19) of the aforesaid Chairman of the Executive Council Resolution No. (22) of 2008. 2. Abolition of the Deaths Committee formed pursuant to Article (37) of the aforesaid Chairman of the Executive Council Resolution No. (22) of 2008, and the transfer of all its functions to the Department. 3. The Clause (1) of Article (13) of the Chairman of the Executive Council Resolution No. (25) of 2006 concerning the issuance of the Executive Regulations of Law No. (23) of 2005 concerning the Health Insurance Scheme in the Emirate of Abu Dhabi, shall be replaced by the following: “The insurance company licensed to operate within the Emirate, and wishes to provide health insurance services in accordance with the health insurance scheme, shall submit an application to the Department to register it as a health insurance company based on the form prepared for this purpose in the Department, provided that the request includes the following: • Information about the licence approved by the concerned entities in the State to work in the field of insurance in the Emirate. • Acknowledgment of the conflict of interest. 2. The Clause (10) of Article 13 of the aforesaid Chairman of the Executive Council Resolution No. (25) of 2006 shall be replaced by the following: “Health insurance companies may not request the cancellation of a work permit in the health insurance scheme, except after the approval of the Department, and publicising it in two daily newspapers in Arabic and English for one time with an acknowledgment regarding the liquidation of obligations. 19 3. The Clause (13) of Article (17) of the aforesaid Chairman of the Executive Council Resolution No. (25) of 2006 shall be replaced by the following: “Medical treatment service providers may not request cancellation of the licence to work in the health insurance scheme, except after the approval of the Department and publicising it in two daily newspapers in Arabic and English for one time with an acknowledgment regarding the liquidation of obligations. 4. This Resolution shall be effective from the date of its issuance Dr. Mohammed Rashid Al Hamli Secretary-General Issuance Date: 15 April 2021 Corresponding to: 02 Ramadan 1442 Hijri 20 Executive Council Resolution No. (50) of 2021 Concerning The Free Zones Council in the Emirate of Abu Dhabi The Executive Council has decided the following: 1. A council called “Abu Dhabi Free Zones Council” (Council) shall be formed under the chairmanship of the Chairman of the Economic Development Department and the membership of one representative from each of the operating entities of the free zones to be named by the entity that owns those entities. 2. Subject to the legislations regulating each of the free zones in the Emirate, the Council shall assume the following competencies: • Propose the general policy of the free zones in the Emirate and submit it to the Executive Council for approval. • Establish an integrated database for free zone affairs in the Emirate in coordination with the concerned entities. • Propose and review the legislations related to the functions of free zones and submit them for approval in accordance with the legislations in force. • Conduct research and studies related to the work affairs of the free zones and propose appropriate solutions for their development. • Coordinate and cooperate between the operating entities in the free zones with the aim of exchanging knowledge, expertise, experiences and practices among them. • Review the policies and strategic plans of each of the free zones and ensure their consistency with the general policy of the free zones in the Emirate. 21 • Approve the non-financial key performance indicators for the free zones. 3. The Council shall issue a regulation specifying the mechanism of its meetings and how to vote on its decisions. 4. All operating entities in the free zones shall be committed to cooperate with the Council and provide it with all what it needs from information, documents and data related to its competencies. 5. The Department of Economic Development shall provide the necessary administrative support to the Council. 6. This Resolution shall be effective from the date of its issuance. Dr. Mohammed Rashid Al Hamli Secretary-General Issuance Date: 15 April 2021 Corresponding to: 02 Ramadan 1442 Hijri 22 Executive Council Resolution No. (55) of 2021 Concerning the Continuity of a Membership in the Board of Trustees of Khalifa University for Science and Technology Having reviewed: Chairman of the Executive Council Resolution No. (8) of 2020 concerning the reformation of the Board of Trustees of Khalifa University for Science and Technology; The Executive Council has decided the following: The membership of His Excellency Mohammed Nasser Al Ahbabi in the Board of Trustees of Khalifa University for Science and Technology shall continue in his personal capacity until the appointment of the Director-General of the UAE Space Agency.
