The Official Gazette 31 December 2019 - The Twelvth Edition The Official Gazette The Twelvth Edition - The Forty Eighth Year Contents Pages Executive Council Resolutions Executive Council Resolution No. (215) of 2019 Concerning the Traffic Violations Early Settlement Initiative. 5 Circulars Circular No. (6) of 2019 Concerning the Transfer of the Employees of the Governmental Entities to the Schedule of Salaries, Grading, Allowances and Bonuses. 11 1 Executive Council Resolutions 3 snoituloseR licnuoC evitucexE Executive Council Resolution No. (215) of 2019 Concerning the Traffic Violations Early Settlement Initiative The Executive Council has decided the following: • The implementation of the Traffic Violations Early Settlement Initiative is approved as follows: First: Rules of Exemption 1. Exempt the perpetrator from the traffic violation by (35%) of the value of the violation and the value of the vehicle seizure, and the whole delay penalty, if any, should the perpetrator pay the dues within (60) days from the date of perpetration of the violation. 2. Exempt the perpetrator from the traffic violation by (25%) of the value of the violation – excluding the value of the vehicle seizure and the delay fine, if any, - should the perpetrator pay the value of the traffic violation after the expiry of (60) days and before the lapse of one year from the date of perpetration of the violation. 3. The value of the violation, vehicle seizure and delay fine shall be settled in full if settlement takes place after the lapse of one year from the date of perpetration of the violation. 4. Reduce the violations perpetrated before the issuance of this Resolution by (50%) with the cancellation of the seizure penalty and black points for a period of (3) months renewable for (3) additional months by a resolution to be issued by the General Commander. Second: The aforementioned clauses shall be applied to all the traffic violations, except for the violations listed in the Schedule of Serious Violations (here-attached). The exemption excludes the procedures ordered or taken by the traffic courts and their prosecution offices. 5 Third: The General Commander of Abu Dhabi Police shall be delegated to lay down the necessary procedures and mechanisms to stimulate the early settlement, including the determination of the maximum traffic violations to the traffic code of the driver to activate the aforementioned rules. Fourth: The Executive Committee may amend the exemption rules or include any of the serious violations within the categories covered by the exemption mentioned in this Resolution based upon the recommendation of the General Commander. Fifth: A quarterly report shall be submitted to the Executive Council on the results of the implementation of the Resolution. This Resolution shall be effective from the date of its issuance and a report shall be submitted within two weeks from the present date on the implementation developments to Abu Dhabi Executive Office by email (confidential) at the following address: ADEO-Legislation@ecouncil.ae Dr. Mohammed Rashid Al Hamli Secretary-General Issuance Date: 15 December 2019 Corresponding to: 18 Rabi’ Al-Akhar 1441 Hijri 6 The Violations Occurring in the Schedule of Serious Violations that are excluded from exemption: No. Subject Name Driving a vehicle in a manner that endangers his life or the life or safety or 1 security of others Driving a vehicle in a manner that would cause damage to public or private 2 facilities 3 Bypassing from the side of the shoulder of the road Driving a heavy vehicle in a manner that endangers his life or the life or 4 safety or security of others Driving a heavy vehicle in a manner that would cause damage to public or 5 private facilities 6 Red light overrun by heavy vehicles The driver of the heavy vehicle has caused any accident resulting in the 7 rollover of the vehicle that he drives or any other vehicle The truck drivers bypass other vehicles in places where bypassing is 8 prohibited 9 Driving a vehicle causing noise 10 Sudden vehicle deviation Being distracted from the road while driving the vehicle because of phone 11 use 12 Being distracted from the road while driving the vehicle in any way 13 Red light overrun by light vehicles 14 Red light overrun by motorcycles 15 Exceeding the speed limit by more than 80 km/h Using the vehicle to transport dangerous or flammable materials without a 16 licence 17 Escaping from the traffic officer 7 18 Not leaving enough distance behind the front vehicles 19 Exceeding the maximum speed limit by more than 60 km/h Failure of the driver of the school bus to extend the stop sign arm and 20 commit to traffic instructions Failure to stop the vehicle after seeing the extension of the stop sign arm of 21 the school buses 22 Use the vehicle for passenger transportation without a licence 23 Not giving way to emergency, ambulance, police and official vehicles 24 Driving a vehicle under the influence of alcohol Driving a vehicle under the influence of narcotic drugs and psychotropic 25 substances or the like 26 Causing a person’s death 27 Causing a serious accident or injuries 8 Circulars 9 sralucriC Date: 31/12/2019 Circular No. (6) of 2019 Concerning the Transfer of the Employees of the Governmental Entities to the Schedule of Salaries, Grading, Allowances and Bonuses To all governmental entities in the Emirate of Abu Dhabi Peace and Allah’s mercy and blessings be upon you, We are pleased to greet you and to extend our sincere gratitude for your continuous cooperation to realise the common interest. In implementation of the Executive Council Resolution No. (223) of 2019 concerning the Schedule of Salaries, Grading, Allowances and Bonuses and Executive Council Resolution No. (224) of 2019 concerning the Transfer of the Employees of the Governmental Entities to the Schedule of Salaries, Grading, Allowances and Bonuses; and whereas both resolutions shall be applicable from the first of January 2020, and based on the approval of the Executive Committee, we kindly urge you to commit to the following: First: The Schedule of Salaries, Grading, Allowances and Bonuses shall be applied to all new appointments from among Nationals and non-Nationals as from the first of January 2020. Second: The transfer of all the current employees who will continue to be in service to the Schedule of Salaries, Grading, Allowances and Bonuses shall be completed within a period that does not exceed three months from the first of January 2020, in accordance with the guidebook issued by the Human Resources Authority of the Emirate of Abu Dhabi. Third: Abu Dhabi Retirement Pensions and Benefits Fund shall be provided with the financial statements related to the details of the salary following the 11 transfer of the National employees and placement thereof on the Schedule of Salaries, Grading, Allowances and Bonuses, following the completion of the placement procedures within the period determined in the aforementioned clause. Fourth: With regard to the National employees who are appointed after the date of 01/01/2020, they shall be registered with Abu Dhabi Retirement Pensions and Benefits Fund, in accordance with the salary designated in the Schedule of Salaries, Grading, Allowances and Bonuses.
