Department : The Department of Culture and Tourism. Alcoholic : The beverages that contain at least 0.05% of alcohol. Beverages 5 Alcoholic : The activities related to the trade, circulation, Beverages Activity possession and manufacture of Alcoholic Beverages as determined by the Department. Article (2) The Alcoholic Beverages Activity shall be considered among the tourist activities falling under the tourism sector in the Emirate and regulated by the Department, including the free zones. Article (3) The applicable policies, rules, regulations, resolutions and circulars shall remain effective in a manner that does not contradict the provisions of this Law until the issuance of the policies, rules, regulations, resolutions and circulars implementing its provisions. Article (4) • The aforesaid Law No. (8) of 1976 shall be repealed. • Any provision or text that is contrary to the provisions of this Law shall be repealed. Article (5) This Law shall be effective from the date of its issuance and published in the Official Gazette. Dr. Mohammed Rashid Al Hamli Secretary-General Issuance Date: 5 July 2020 Corresponding to: 14 Thu Al Qidah 1441 Hijri 16 Executive Council Resolution No. (118) of 2020 Concerning Abu Dhabi Centre for Sheltering & Humanitarian Care (EWAA) The Executive Council has decided the following: First: A centre called “Abu Dhabi Centre for Sheltering and Humanitarian Care - Ewaa” shall be established and affiliated to the Department of Community Development. Second: • The Centre shall replace Abu Dhabi Centre for sheltering Women and Children, and all of its assets, properties, rights and obligations shall be novated thereto. • The employees and workers of Abu Dhabi Centre for sheltering Women and Children shall be transferred to the Centre without prejudice to their financial allocations. Third: • Her Highness, the Supreme Chairwoman of the Family Development Foundation, shall be the honorary President of the Centre. • The Centre shall submit an annual report on its functioning, activities, achievements, proposals and recommendations to the honorary President. Fourth: The Centre aims to achieve a humanitarian mission based on sheltering, caring, and providing safe shelter as well as health and psychological care for victims of human trafficking and victims of domestic violence and all forms of violence, and shall in particular have the following competencies: • Provide care and rehabilitation to victims of violence, including an adequate shelter for them. • Develop and implement rehabilitation programs in order to empower victims of violence and reintegrate them into society or their homelands, and set up an appropriate mechanism to follow up on them after they leave the shelter in cooperation and coordination with the concerned entities. 17 • Fulfil the needs of the victims of violence, protect their rights, provide them with the necessary advice, and resolve their problems and disputes in amicable ways whenever possible. • Receive financial and in-kind contributions provided to the victims of violence in accordance with applicable legislations. • Help victims of violence in the stages of collecting evidence and investigations, guarantee their right of defence, and inform them of their rights and duties, in coordination with the concerned entities. • Develop awareness-raising programs to prevent and reduce crimes of human trafficking, violence and abuse in all its forms, in coordination with the concerned entities. • Coordinate with Radio-TV media to show the risks of human trafficking crimes, violence and abuse. • Conclude agreements and memoranda of understanding and enter into partnerships related to the Centre’s competencies. • Prepare specialised research and studies in the field of the Centre’s function, examine the best local, regional and international practices, and propose the best solutions and recommendations. Fifth: The Centre shall be managed by a General Director who shall be appointed by an Executive Council Resolution and undertake the following competencies: • Propose strategic and executive plans for the Centre and submit them to the Community Development Department. • Follow up on the implementation of the strategic and executive plans of the Centre. • Manage, develop and implement all strategic and executive tasks assigned to the Centre, either directly or through the working groups determined thereby. • Propose initiatives, programs, projects, studies and recommendations related to the functions and activities of the Centre and submit them to the Department of Community Development. • Form internal committees and working groups from among the staff of the Centre and elsewhere and determine their tasks and procedures of their work. 18 • Propose legislations, organisational and executive regulations, rules, policies, resolutions, and circulars related to the Centre’s functions and submit them to the Department of Community Development. • Prepare periodic reports on the progress of work at the Centre and submit them to the Department of Community Development. • Any other functions or tasks assigned to him by the Chairman of the Department of Community Development. Sixth: The Department of Community Development shall provide the Centre with the necessary administrative and logistical support to carry out its competencies. Seventh: Funds shall be allocated to the Centre within the annual budget of the Department of Community Development. Eighth: The Centre shall be subject to the regulations, rules and resolutions in force in the Department of Community Development. Ninth: Executive Council Resolution No. (64) of 2019 concerning the establishment of Abu Dhabi Centre for sheltering Women and Children or any other resolutions that conflict with the provisions of this Resolution, shall be repealed. Tenth: This Resolution shall be published in the Official Gazette and be effective from the date of its publication. Dr. Mohammed Rashid Al Hamli Secretary-General Issuance Date: 8 July 2020 Corresponding to: 17 Thu Al Qidah 1441 Hijri 19 Executive Council Resolution No. (123) of 2020 Concerning the Exemption of the Violators of the Health Insurance Law from the Prescribed Fines The Executive Council has decided the following: 1. Approve to exempt business owners from the fines imposed upon them for violating Abu Dhabi Health Insurance Law No. (23) of 2005, provided that the situation of those violating the law is adjusted and corrected up to 01/10/2020. 2. Approve the exemption of establishments whose licences have been cancelled and commercial activity has been suspended, from the value of the fines imposed upon them for violating Abu Dhabi Health Insurance Law No. (23) of 2005 until the date of issuance of this resolution. 3. Urge you, in coordination with the Department of Economic Development and the relevant entities, to study the current situation of the nature of health insurance violations and their governance in order to limit the recurrence of such violations, and to inform the Executive Council of the result within a month from the date of issuance of this Resolution.
