ALBERTA ORDER OF EXCELLENCE ACT Chapter A‑29 Table of Contents 1 Definitions 2 Establishment of Alberta Order of Excellence 3 Chancellor and members of the Order 4 Governing body 5 Duties of the Council 6 Regulations 7 Membership 8 Evidence of membership 9 Resignation 10 Termination of membership 11 Administrative services 12 Offences HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Definitions 1 In this Act, (a) “Chancellor” means the Chancellor of the Order; (b) “Council” means the Council of the Order; (c) “Minister” means the Minister determined under section 16 of the Government Organization Act as the Minister responsible for this Act; (d) “Order” means the Alberta Order of Excellence. RSA 1980 cA‑35 s1 Establishment of Alberta Order of Excellence 2 (1) There is hereby established a society of honour to be known as the Alberta Order of Excellence consisting of those persons who are members of the Order. (2) The object of the Order is to accord recognition to those persons who have rendered service of the greatest distinction and of singular excellence for or on behalf of the residents of Alberta. RSA 1980 cA‑35 s2 Chancellor and members of the Order 3 (1) The Lieutenant Governor is the Chancellor of the Order. (2) The Chancellor and former Chancellors are members of the Order. RSA 1980 cA‑35 s3 Governing body 4 (1) The governing body of the Order is the Council consisting of not more than 6 persons appointed by the Lieutenant Governor in Council. (2) A quorum of the Council is a majority of its members. (3) The Lieutenant Governor in Council (a) shall designate one of the members of the Council as chair, and (b) may designate other members of the Council to act in the place of the chair during the chair’s absence or inability to act or during a vacancy in the office of chair. (4) A person is not a member of the Order by reason only of being a member of the Council. (5) The members of the Council may be paid remuneration and living and travelling expenses as prescribed by the Lieutenant Governor in Council. (6) The term of office (a) of the chair of the Council is for 3 years or until the chair’s successor is designated, whichever is the greater period of time, and (b) of a member of the Council, other than the chair, is for a term, not exceeding 3 years, prescribed by the Lieutenant Governor in Council. (7) A member of the Council is eligible for reappointment to the Council. RSA 1980 cA‑35 s4;1982 c6 s2;1985 c5 s2 Duties of the Council 5 (1) The Council shall (a) advise the Chancellor on matters concerning the Order, (b) recommend to the Chancellor persons to be granted membership in the Order, and (c) carry out those duties and perform those functions that it considers proper to ensure that the Order meets its objective. (2) The Council may make bylaws governing the conduct of business of the Order and the Council. RSA 1980 cA‑35 s5 Regulations 6 The Lieutenant Governor in Council may make regulations (a) prescribing the seal, motto and insignia of the Order; (b) governing the use and display of the insignia of the Order. RSA 1980 cA‑35 s6 Membership 7 (1) Subject to section 3, the Chancellor shall, on the recommendation of the Council, grant membership in the Order. (2) Subject to subsection (4), not more than 10 persons may be granted membership in the Order in each year. (3) A person may be granted membership in the Order posthumously if the Council made the recommendation for membership prior to that person’s death. (4) The limitation respecting the number of persons who may be granted membership in the Order in each year does not apply to persons granted membership in the Order posthumously. RSA 2000 cA‑29 s7;2005 c5 s2 Evidence of membership 8 The membership of a person in the Order (a) is to be evidenced by a document signed by the Chancellor and affixed with the seal of the Order, and (b) is effective on the date (i) the document is issued, or (ii) specified in the document, if the membership is to be effective on a date other than the date the document is issued. RSA 1980 cA‑35 s8 Resignation 9 A member may resign from the Order by giving a written notice to the Chancellor to that effect signed by the member. RSA 1980 cA‑35 s9 Termination of membership 10 On the recommendation of the Council, the Chancellor shall terminate a person’s membership in the Order. RSA 1980 cA‑35 s10 Administrative services 11 The Minister may provide to the Order and the Council the services of employees of the Government under the Minister’s administration to carry out secretarial, clerical and accounting duties and other work required by the Order or the Council. RSA 1980 cA‑35 s11 Offences 12 A person who is not a member of the Order and who (a) holds out that the person is a member of the Order, or (b) displays or uses an insignia of the Order, is guilty of an offence and liable to a fine not exceeding $2000. RSA 1980 cA‑35 s12
