BLIND WORKERS ’ COMPENSATION ACT Chapter B‑4 Table of Contents 1 Definitions 2 Payment by Treasurer 3 Previous awards 4 Assessment on employer 5 Work and placement of blind worker 6 Access to workplace 7 Certificates HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Definitions 1 In this Act, (a) “blind worker” means a worker as defined in the Workers’ Compensation Act , and possessing a central visual acuity of the worker’s better eye reading 6‑60 or 20‑200 or less, either with or without glasses; (b) “Board” means The Workers’ Compensation Board; (c) “employer” means an employer as defined in the Workers’ Compensation Act who employs a blind worker; (d) “full cost of compensation” includes (i) compensation, burial expenses, the cost of furnishing medical aid and all other amounts payable under or by virtue of the Workers’ Compensation Act , by reason of an accident to a blind worker for which the worker is entitled to compensation under that Act, and (ii) the capitalized sum or present value of the sum required as determined by the Board to provide for future payments of compensation to the worker or the worker’s dependants; (e) “Institute” means the Canadian National Institute for the Blind; (f) “Minister” means the Minister determined under section 16 of the Government Organization Act as the Minister responsible for this Act. RSA 2000 cB‑4 s1;2006 c23 s15 Payment by Treasurer 2 (1) When the full cost of compensation exceeds $50, the Minister in the case of an industry to which the Workers’ Compensation Act applies (a) shall, when the employer is not individually liable to pay the compensation, pay the excess of the full cost of compensation over $50 to the Board by way of reimbursement to the Accident Fund as defined in the Workers’ Compensation Act , and (b) shall, when the employer is individually liable to pay compensation, pay the excess of the full cost of compensation over $50 to the employer. (2) The excess of the full cost of compensation required to be paid under subsection (1) shall be paid out of the General Revenue Fund on receiving from the Board a certificate of the full cost of compensation. (3) The certificate of the full cost of compensation may be accepted by the Minister without further proof. RSA 2000 cB‑4 s2;2006 c23 s15 Previous awards 3 In making an award under the Workers’ Compensation Act to a blind worker for injury by accident under the Workers’ Compensation Act , the Board may have regard to previous awards made to the worker for injury under that Act. RSA 1980 cB‑7 s3 Assessment on employer 4 The assessment on the wages of a blind worker to be levied by the Board on an employer may be fixed by the Board at an amount that the Board considers fair, having regard to the provisions of the Workers’ Compensation Act . RSA 1980 cB‑7 s4 Work and placement of blind worker 5 (1) Subject to subsection (2), the Institute has exclusive jurisdiction over the nature of the work a blind worker is required to do, and in the proper placement of the blind worker. (2) On the recommendation of the Board, the Lieutenant Governor in Council may designate another organization or institution to exercise the powers and perform the duties assigned to the Institute under this Act and, on such designation, this Act shall be read as though the name of the other organization or institution were substituted for that of the Institute. RSA 1980 cB‑7 s5 Access to workplace 6 Officers of the Institute may, with the knowledge and consent of the superintendent, foreman or person in charge, enter at all reasonable times the place of employment of a blind worker. RSA 1980 cB‑7 s6 Certificates 7 The Institute shall provide the Board, on request, with all certificates or other material required by the Board in the fulfilment of its duties. RSA 1980 cB‑7 s7
