Dunvegan Hydro Development Act

DUNVEGAN HYDRO DEVELOPMENT ACT Chapter D‑18 Preamble WHEREAS an application was made by Glacier Power Ltd. for a hydro development; WHEREAS on December 22, 2008, an independent Joint Review Panel of the Alberta Utilities Commission, the Natural Resources Conservation Board and the Canadian Environmental Assessment Agency released the “Report of the Joint Review Panel, Glacier Power Ltd., Dunvegan Hydroelectric Project, Fairview, Alberta” dated December 19, 2008; WHEREAS the Alberta Utilities Commission has reported on the application to the Lieutenant Governor in Council in accordance with section 9(5) of the Hydro and Electric Energy Act ; and WHEREAS section 9(6) of the Hydro and Electric Energy Act requires that the Executive Council cause a Bill to be prepared for the authorization of an order of the Alberta Utilities Commission for construction of the hydro development; THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Authorization 1 (1) The Alberta Utilities Commission is authorized to make an order for the construction and operation of a hydro development as described in the “Report of the Joint Review Panel, Glacier Power Ltd., Dunvegan Hydroelectric Project, Fairview, Alberta” dated December 19, 2008. (2) Notwithstanding section 10 of the Hydro and Electric Energy Act , the authorization of the Lieutenant Governor in Council is not required.
