This Act authorizes licences and licence amendments for transferring treated municipal water between the North Saskatchewan River Basin and the Beaver River Basin, subject to annual volume limits.
BEAVER RIVER BASIN WATER AUTHORIZATION ACT Chapter B‑1.5 Preamble WHEREAS the communities and residents within the County of St. Paul No. 19, Smoky Lake County and the White Fish Lake Indian Reserve 128 are experiencing problems with the quantity and quality of water from their individual existing potable water supplies; WHEREAS supplying water from the North Saskatchewan River Basin to those communities and residents would provide reliable treated municipal water to those communities and residents, but the piping and discharge of treated water would result in a transfer of water to the Beaver River Basin; WHEREAS section 47 of the Water Act requires a special Act of the Legislature to authorize the issuance of licences to transfer water between major river basins; and WHEREAS the Minister of Environment and Parks has complied with section 48 of the Water Act ; THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: County of St. Paul No. 19 water authorization 1 For the purposes of this Act, licences and amendments to licences pursuant to the Water Act in respect of the communities and residents within the County of St. Paul No. 19 are authorized to be issued for the transfer of treated municipal water between the North Saskatchewan River Basin and the Beaver River Basin, in an amount not to exceed 51.1 cubic decametres annually. Smoky Lake County and White Fish Lake Indian Reserve 128 water authorization 2 For the purposes of this Act, licences and amendments to licences pursuant to the Water Act in respect of the communities and residents within Smoky Lake County and the White Fish Lake Indian Reserve 128 are authorized to be issued for the transfer of treated municipal water between the North Saskatchewan River Basin and the Beaver River Basin, in an amount not to exceed 550 cubic decametres annually. Appeals 3 No appeal lies to the Environmental Appeals Board from a decision to issue a licence authorized under section 1 or 2.
