Canyon Creek Hydro Development Act

CANYON CREEK HYDRO DEVELOPMENT ACT Chapter C‑2.2 Preamble WHEREAS an application was made by Turning Point Generation for a hydro development designated as the Canyon Creek Pumped Hydro Energy Storage Project; WHEREAS on August 2, 2018, the Alberta Utilities Commission issued Decision 22934‑D01‑2018 “Turning Point Generation Canyon Creek Pumped Hydro Energy Storage Project”, in which it found that approval of the application would be in the public interest; WHEREAS the Alberta Utilities Commission has reported on the application to the Lieutenant Governor in Council in accordance with section 9(5) of the Hydro and Electric Energy Act ; and WHEREAS section 9(6) of the Hydro and Electric Energy Act requires that the Executive Council cause a Bill to be prepared for the authorization of an order of the Alberta Utilities Commission for construction of the hydro development; THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Authorization 1 (1) The Alberta Utilities Commission is authorized to make an order for the construction and operation of a hydro development as described in its Decision 22934‑D01‑2018 “Turning Point Generation Canyon Creek Pumped Hydro Energy Storage Project” dated August 2, 2018. (2) Notwithstanding section 10 of the Hydro and Electric Energy Act , the authorization of the Lieutenant Governor in Council is not required.
