The regulation generally allows use of Alberta official emblems, but restricts use of the armorial bearings unless permission applies or a listed exemption covers the user.
(Consolidated up to 76/2023) ALBERTA REGULATION 156/2013 Emblems of Alberta Act OFFICIAL EMBLEMS (MINISTERIAL) REGULATION Table of Contents 1 Official emblems other than armorial bearings 2 Armorial bearings 3 Repeal 5 Coming into force Official emblems other than armorial bearings 1 (1) Subject to subsection (2), a person may reproduce, use or display an official emblem other than the armorial bearings of Alberta. (2) A person who reproduces, uses or displays the provincial shield of Alberta shall ensure that the reproduction, use or display is based on and conforms to original drawings of the provincial shield of Alberta obtained from the Government. Armorial bearings 2 (1) No person shall reproduce, use or display (a) the armorial bearings of Alberta unless the Minister has given the person written permission to do so under subsection (4), or (b) a design so nearly resembling the armorial bearings of Alberta as to be likely to be mistaken for the armorial bearings of Alberta. (2) A person may apply to the Minister for permission to reproduce, use or display the armorial bearings of Alberta. (3) An application under subsection (2) must be in writing and include (a) the purpose of the proposed reproduction, use or display, and (b) an illustration showing how the armorial bearings of Alberta will appear when reproduced, used or displayed. (4) On receiving an application under subsection (2), the Minister may give a person written permission to reproduce, use or display the armorial bearings of Alberta if the Minister considers it appropriate to do so and may impose any conditions the Minister considers appropriate in respect of the permission. (5) Notwithstanding subsection (1)(a), the following may reproduce, use or display the armorial bearings of Alberta: (a) the Lieutenant Governor and the office of the Lieutenant Governor; (b) the Premier and the office of the Premier; (c) the Executive Council and the members of the Executive Council and their offices; (d) the Legislative Assembly and the members of the Legislative Assembly and their offices; (e) the Court of Appeal; (f) the Court of King’s Bench; (g) the Court of Justice and the judges of the Court. (6) A person who reproduces, uses or displays the armorial bearings of Alberta shall (a) ensure that the reproduction, use or display is based on and conforms to original drawings of the armorial bearings obtained from the Government, (b) ensure that the display and placement of the armorial bearings of Alberta is in accordance with the Alberta Government Corporate Identity Manual, as amended from time to time, and (c) if the person was given written permission to reproduce, use or display the armorial bearings of Alberta under subsection (4), comply with any conditions imposed by the Minister. Coming into force 5 This Regulation comes into force on the coming into force of section 2 of the Statutes Amendment Act, 2013 .
