Pending Registration Queue Regulation

(Consolidated up to 106/2024) ALBERTA REGULATION 43/2021 Land Titles Act PENDING REGISTRATION QUEUE REGULATION Examination and registration out of order 1 For the purposes of section 14.1(5) of the Act, an instrument or caveat in the pending registration queue may be examined and registered in an order other than the order in which it is entered in the pending registration queue if, in the Registrar’s opinion, doing so (a) is required to correct an error made by the Registrar, (b) is required to comply with a court order, or (c) will not affect any other estate or interest in respect of which an instrument or caveat has been entered in the pending registration queue in relation to the same land affected by the instrument or caveat that is proposed to be examined and registered out of order. Prescribed time 2 For the purposes of section 14.1(6)(a)(i) and (ii) of the Act, the prescribed time is 30 days after the date on which the Registrar first returns the instrument or caveat for correction. Expiry 3 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on May 31, 2029.
