(no amdt) alberta regulation 203/2024 Alberta Utilities Commission Act ELECTRIC ENERGY LAND USE AND VISUAL ASSESSMENT REGULATION Table of Contents 1 Definitions 2 Application of Regulation 3 Application of other laws 4 Agricultural land use and coexistence with wind and solar power plants 5 Reporting on agricultural productivity 6 Irrigability assessments for land within White Area 7 Designation of zones 8 Development requirements and restrictions within buffer zones and visual impact assessment zones 9 Expiry Schedules Definitions 1 In this Regulation, (a) “agricultural impact assessment” means an assessment that evaluates the anticipated effects of a wind power plant or solar power plant on agricultural productivity, including measures to achieve coexistence with agricultural operations; (b) “AUC Rule 007” means AUC Rule 007: Applications for Power Plants, Substations, Transmission Lines, Industrial System Designations, Hydro Developments and Gas Utility Pipelines , as published by the Commission and amended from time to time; (c) “buffer zone” means an area of land designated in section 7(1) to be a buffer zone and described in Schedule 2; (d) “coexistence” means the concurrent use of land for a wind power plant or solar power plant and agricultural production; (e) “Commission” means the Alberta Utilities Commission (AUC); (f) “high‑quality agricultural land” means land rated under the Land Suitability Rating System (LSRS) as (i) Class 1 or Class 2 land, or (ii) Class 3 land that is situated within a municipality listed in Schedule 1; (g) “irrigability assessment” means an assessment of the suitability of land for irrigation; (h) “Land Suitability Rating System (LSRS)” means the system for evaluating land suitability based on soil, landscape and climate factors, as described in Land Suitability Rating System for Agricultural Crops: 1. Spring-seeded small grains , published by Agriculture and Agri-Food Canada in 1995 and amended from time to time; (i) “power plant” means the facilities for generating and gathering electric energy from any source; (j) “solar power plant” means a power plant that generates electricity from sunlight; (k) “visual impact assessment” means an assessment to determine changes to the scenic attributes of a landscape brought about by the introduction of visual contrasts and the associated changes in the visual experience of the landscape; (l) “visual impact assessment zone” means an area of land designated in section 7(2) to be a visual impact assessment zone and described in Schedule 3; (m) “White Area” means that part of Alberta shown outlined and coloured white on the map annexed to (i) Ministerial Order M.O. 71/85 dated May 7, 1985 and made pursuant to section 10 of the Public Lands Act, RSA 1980 cP-30, as that Order is amended from time to time, or (ii) any order made in substitution for that Order, as amended from time to time; (n) “wind power plant” means a power plant that generates electricity from wind. Application of Regulation 2 (1) Unless exempted under subsection (2), this Regulation applies to applications for the construction or operation of power plants under AUC Rule 007. (2) This Regulation does not apply to the following: (a) the construction or operation of the following types of power plants: (i) small power plants, as defined in section 3(1)(b) of the Hydro and Electric Energy Regulation (AR 32/2024); (ii) isolated generating units, within the meaning of the Isolated Generating Units and Customer Choice Regulation (AR 165/2003); (iii) micro‑generation generating units, as defined in the Micro‑generation Regulation (AR 27/2008); (b) the construction or operation of a power plant situated on a reserve, as defined in the Indian Act (Canada); (c) any alteration to an existing power plant approval issued by the Commission, as set out in section 2(2) of the Hydro and Electric Energy Regulation (AR 32/2024). Application of other laws 3 This Regulation does not exempt any person from complying with any other applicable federal, provincial or municipal laws or regulations respecting the same subject‑matter. Agricultural land use and coexistence with wind and solar power plants 4 (1) A person applying for the construction or operation of a wind power plant or solar power plant on privately owned high‑quality agricultural land must submit an agricultural impact assessment as part of the application. (2) An agricultural impact assessment under subsection (1) must include (a) details of the expected effect of the wind power plant or solar power plant on agricultural productivity, and (b) measures demonstrating that the wind power plant or solar power plant is designed to achieve coexistence with agricultural land use. Reporting on agricultural productivity 5 (1) The owner or operator of a wind power plant or solar power plant situated on privately owned high‑quality agricultural land must, within 36 months from the start of operations, submit a report to the Commission that confirms the agricultural productivity of the land. (2) The report under subsection (1) must be filed in accordance with any rules made by the Commission regarding the reporting and assessment of agricultural productivity following the construction of a power plant on high‑quality agricultural land. Irrigability assessments for land within White Area 6 (1) If required by the Commission, a person applying for the construction or operation of a power plant within the White Area must submit an irrigability assessment as part of the application. (2) If an irrigability assessment is required under subsection (1), the assessment may include (a) an evaluation of water quality and availability, (b) an analysis of proximity to irrigation infrastructure, (c) the economic viability or feasibility of irrigation, and (d) the opinions of the relevant irrigation district, if applicable. Designation of zones 7 (1) The areas of land described in Schedule 2 are designated as buffer zones. (2) The areas of land described in Schedule 3 are designated as visual impact assessment zones. Development requirements and restrictions within buffer zones and visual impact assessment zones 8 (1) Subject to subsection (3), a person applying for the construction or operation of a power plant within a buffer zone or a visual impact assessment zone must submit a visual impact assessment as part of the application. (2) A visual impact assessment under subsection (1) must include (a) an evaluation of the anticipated visual impacts on the buffer zone or visual impact assessment zone, (b) visual simulations from key vantage points illustrating the potential visual impact of the proposed power plant, and (c) proposed mitigation measures to minimize or offset any adverse visual effects on the buffer zone or visual impact assessment zone. (3) The Commission shall not accept any applications under AUC Rule 007 for the construction or operation of a wind power plant in a buffer zone. Expiry 9 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on December 31, 2029.
