(no amdt) alberta registries 214/2024 Provincial Health Agencies Act HEALTH SERVICES DELIVERY ORGANIZATION DESIGNATION REGULATION Table of Contents 1 Definition 2 Additional factors 3 Termination of designation 4 Notice 5 Expiry 6 Coming into force Definition 1 In this Regulation, “health services delivery agreement” means an agreement referred to in section 1.97(1)(a) of the Act. Additional factors 2 For the purposes of section 1.97(1)(d) of the Act, each of the following is a factor to be considered by a sector Minister before designating a person as a health services delivery organization: (a) whether the health services to be delivered under the health services delivery agreement are consistent with (i) the strategic direction of the oversight Minister and the sector Minister referred to in sections 1.1(1) and 1.2(1) of the Act, and (ii) the strategic goals and objectives of the oversight Minister and the sector Minister referred to in sections 1.1(2)(a) and 1.2(2)(a) of the Act; (b) whether the health services to be delivered under the health services delivery agreement are identified as high priority by the sector Minister; (c) whether the health services to be delivered under the health services delivery agreement are or will be delivered to a significant portion of the individuals who require those health services. Termination of designation 3 (1) For the purposes of section 1.97(1.1) of the Act, a sector Minister may terminate a designation if the sector Minister is satisfied that (a) the health services delivery organization has failed to comply with the Act, (b) the health services delivery organization or its board has failed to comply with a directive referred to in section 8(1)(d) of the Act, (c) the health services delivery organization has failed to adequately exercise its powers or carry out its duties, responsibilities or functions, or (d) termination of the designation is necessary or appropriate. (2) A designation of a health services delivery organization terminates when the health services delivery agreement expires or is terminated. Notice 4 The sector Minister shall provide a written notice to a person or a health services delivery organization, as the case may be, at least 30 days before (a) designating the person as a health services delivery organization, or (b) terminating the designation of the health services delivery organization. Expiry 5 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on April 30, 2034. Coming into force 6 This Regulation comes into force on the coming into force of section 18(9) of the Health Statutes Amendment Act, 2024 (No. 2) .
