This Act says certain international agreements are not binding on Alberta, and not part of Alberta domestic law, unless they are implemented by or under an Act of the Alberta Legislature.
INTERNATIONAL AGREEMENTS ACT Chapter I‑3.8 Preamble WHEREAS the Government of Alberta recognizes the benefits of and supports increased international trade, investment and cooperation; WHEREAS the Government of Canada has entered and from time to time does enter into international agreements that include matters that are not exclusively within federal jurisdiction, including matters within provincial jurisdiction; WHEREAS the Government of Alberta has the responsibility and authority to decide whether and how to implement the provisions of international agreements that are not exclusively within federal jurisdiction; and WHEREAS the Government of Alberta is only bound by the provisions of an international agreement that are not exclusively within federal jurisdiction if those provisions are or have been implemented by or under an Act of the Legislature of Alberta; THEREFORE HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Definitions 1 In this Act, (a) “international agreement” means an agreement entered into by the Government of Canada or a Minister, agency or official of the Government of Canada and (i) one or more foreign countries or states, or any agency or official of those foreign countries or states, or (ii) an international organization; (b) “international organization” means an organization with an international membership, mission or presence and includes both non‑governmental organizations and governmental organizations. Application 2 This Act applies to international agreements entered into before or after the coming into force of this Act. Provincial approval required 3 An international agreement, or a part of an international agreement, that includes a matter that is not exclusively within federal jurisdiction is not binding on the Government of Alberta and is not part of the domestic law of Alberta unless that international agreement, or that part of the international agreement, is implemented by or under an Act of the Legislature of Alberta. Repeal 4 The International Trade and Investment Agreements Implementation Act is repealed.
