ALBERTA HERITAGE SCHOLARSHIP ACT Chapter A‑24 Table of Contents 1 Definitions 2 Alberta Heritage Scholarship Fund 3 Alberta Heritage Scholarships 5 Scholarship payments 6 Requirement to maintain original endowment 7 Regulations HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Definitions 1 In this Act, (a) “Alberta Heritage Scholarship” means a scholarship under section 3(1); (b) “Crown” means the Crown in right of Alberta; (c) “Fund” means the Alberta Heritage Scholarship Fund; (d) “Minister” means the Minister determined under section 16 of the Government Organization Act as the Minister responsible for this Act; (e) “scholarship” means an Alberta Heritage Scholarship or another scholarship under this Act and, in the case of an Alberta Heritage Scholarship, includes an award of distinction, prize or incentive under the regulations. 1981 cA‑27.1 s1;1995 c4 s2;1998 c30 s1 Alberta Heritage Scholarship Fund 2 (1) The Alberta Heritage Scholarship Fund created by this Act is continued. (2) The following shall be paid into the Fund: (a) gifts made to the Crown to provide scholarships and consisting of money or of investments that are readily capable of being realized and that have an ascertainable value at any given date; (b) money received under agreements between the Crown and any other government if an object of the agreement is to provide scholarships; (b.1) repealed 2025 c23 s2; (c) other payments of money or transfers of investments approved by the Minister. (2.1) Repealed 2019 c20 s8. (2.2) Repealed 2014 c16 s3. (3) The President of Treasury Board and Minister of Finance (a) shall, subject to this Act and the regulations, hold and administer the Fund and has the same powers of investment and of making loans with respect to the Fund that the President of Treasury Board and Minister of Finance has with respect to the General Revenue Fund under the Financial Administration Act , and (b) may be a participant under section 40 of the Financial Administration Act on behalf of the Fund. (4) All income of and all appreciation and depreciation in the value of the assets of the Fund accrue to and form part of the Fund. (5) The President of Treasury Board and Minister of Finance shall, as soon as practicable after the end of each fiscal year of the Crown, prepare in accordance with the Financial Administration Act a report of the financial transactions of the Fund during the preceding fiscal year. RSA 2000 cA‑24 s2;2004 c7 s19;2005 c12 s18;2006 c23 s7; 2013 c10 s32;2014 cS‑2.5 s9;2014 c16 s3;2019 c20 s8;2025 c23 s2 Alberta Heritage Scholarships 3 (1) The Minister is responsible for the provision of Alberta Heritage Scholarships from the Fund to (a) recognize and reward the scholastic achievements of residents of Alberta and provide them with incentives to pursue post‑secondary education in Alberta, (b) enable outstanding students who are residents of Alberta to pursue post‑secondary education outside Alberta, (c) enable outstanding students from outside Alberta to pursue post‑secondary education in Alberta, and (d) encourage and reward persons who have displayed outstanding ability in at least one of several fields of endeavour, including, without limitation, the fine arts, performing arts, social sciences, the humanities, applied arts, physical sciences, education, career development, athletics and recreation. (2) Alberta Heritage Scholarships shall consist of the classes of scholarships, awards of distinction, prizes and incentives prescribed in the regulations. (3) The Minister is also responsible for the provision of other scholarships to recognize and reward persons or classes of persons who are eligible to receive scholarships from money or investments referred to in section 2(2). (4) With respect to scholarships referred to in section 2(2) that derive from gifts or from money or investments paid or transferred under an agreement, the Minister may consider any directions given by the one who made the gift or given under the agreement, as the case may be. 1981 cA‑27.1 s3;1995 c4 s4;1998 c30 s1 4 and 4.1 Repealed 2017 c16 s6. Scholarship payments 5 The President of Treasury Board and Minister of Finance shall, at the request of the Minister made on reasonable notice, pay from the Fund money that is required by the Minister (a) for providing scholarships pursuant to this Act and the regulations, and (b) subject to any regulations made under section 7(g), for paying the costs of administering scholarships pursuant to this Act and the regulations. RSA 2000 cA‑24 s5;2006 c23 s7;2013 c10 s32 Requirement to maintain original endowment 6 No portion of the original endowment paid from the Alberta Heritage Savings Trust Fund into the Fund following the Fund’s establishment in 1981 may be paid out of the Fund. 1981 cA‑27.1 s7;1995 c4 s7 Regulations 7 The Lieutenant Governor in Council may make regulations (a) prescribing classes of scholarships, awards of distinction, prizes and incentives for the purposes of section 3(2); (b) with reference to Alberta Heritage Scholarships and subject to section 6, fixing the maximum amount of money that may be paid annually under the regulations; (c) with reference to Alberta Heritage Scholarships, fixing the maximum amount of money that may be paid as a scholarship, award of distinction, prize or incentive in a class of scholarship, award of distinction, prize or incentive; (d) respecting the powers and duties of the Minister with respect to the granting of scholarships, awards of distinction, prizes and incentives; (e) respecting the qualifications of and residence requirements for applicants for scholarships, awards of distinction, prizes and incentives; (f) respecting the terms and conditions on which scholarships, awards of distinction, prizes and incentives may be provided; (g) respecting the charging of fees with regard to money or gifts received under section 2(2)(a), (b) and (c) to cover the costs incurred by the Government in administering scholarships. 1981 cA‑27.1 s8;1995 c4 s8;1998 c30 s1
