Treatment Services Regulation

(Consolidated up to 99/2026) ALBERTA REGULATION 248/85 Public Health Act TREATMENT SERVICES REGULATION 1 For the purposes of section 12 of the Public Health Act , the Minister may provide the following services and the supplies, equipment, care, drugs, medicines or biological agents referred to in this Regulation in respect of the provision of those services: (a) Congenital Cleft dental services; (b) Mobius Syndrome dental services; (c) Cystic Fibrosis treatment; (d) Phenylketonuria treatment; (e) a Penicillin Prophylaxis program to prevent further medical complications as a result of a person having had Rheumatic Fever. AR 248/85 s1;17/99;251/2001;297/2003 2 (1) To be eligible for Congenital Cleft dental services a person shall (a) be a resident of Alberta, (b) be registered at (i) the Stollery Children’s Hospital Cleft Lip and Palate Clinic, or (ii) the Alberta Children’s Hospital Cleft Lip and Palate Clinic, (c) be certified as having a congenital cleft of the alveolar ridge by the personnel of a clinic referred to in clause (b), and (d) be authorized by the personnel of a clinic referred to in clause (b) to receive the treatment. (2) Where dental treatment associated with a congenital cleft of the alveolar ridge is authorized by a clinic referred to in subsection (1)(b), the Minister shall pay for the costs of that treatment in accordance with the Cleft Palate Dental Indemnity Program Dental Fee Payment Guidelines , as approved and published by the Minister and as amended by the Minister from time to time. AR 248/85 s2;17/99;297/2003;142/2010 3 (1) To be eligible for treatment of the medical condition Mobius Syndrome a person shall (a) be less than 18 years of age, (b) be a resident of Alberta, (c) be diagnosed as having the medical condition Mobius Syndrome by a physician authorized to practise (i) in Alberta, or (ii) in Alberta or Saskatchewan, in the case of a resident of Alberta receiving dental services in Lloydminster, and (d) have a document from a physician referred to in clause (c) in which the physician certifies that the person has the medical condition Mobius Syndrome. (2) The Minister shall pay for the costs relating to restorative, surgical and prosthetic dental care used for the treatment of the medical condition Mobius Syndrome. (3) Notwithstanding subsection (2), the Minister shall not pay for surgical costs if they are paid for under Part 1 of the Alberta Health Care Insurance Act . AR 248/85 s3;291/2025 4 (1) To be eligible for treatment of the medical condition Cystic Fibrosis a person shall (a) be less than 18 years of age, (b) be a resident of Alberta, (c) be diagnosed as having the medical condition Cystic Fibrosis by a physician on behalf of (i) the Stollery Children’s Hospital Cystic Fibrosis Clinic, or (ii) the Alberta Children’s Hospital Cystic Fibrosis Clinic. (2) The Minister shall pay for the costs of all antibiotics and pancreatic enzymes used for the treatment of the medical condition Cystic Fibrosis that are prescribed by a physician on behalf of a clinic referred to in subsection (1)(c). AR 248/85 s4;142/2010 5 (1) To be eligible for treatment of Phenylketonuria a person shall (a) be less than 7 years of age, (b) be a resident of Alberta, and (c) be diagnosed as having Phenylketonuria by a physician on behalf of (i) the Stollery Children’s Hospital Medical Genetics Clinic, or (ii) the Alberta Children’s Hospital Inherited Metabolic Disorders Clinic. (2) The Minister shall pay for the costs of all special dietary items used for the treatment of Phenylketonuria that are prescribed by a physician of the clinic referred to in subsection (1)(c). (3) Notwithstanding subsection (1)(a), where a physician referred to in subsection (1)(c) recommends that a person 7 years of age or older be treated for Phenylketonuria, the Minister may pay for that treatment under subsection (2). AR 248/85 s5;142/2010 6 (1) To be eligible for the Penicillin Prophylaxis program a person shall (a) be less than 18 years of age, (b) be a resident of Alberta, (c) be diagnosed according to the Jones criteria as having acute Rheumatic Fever by a physician authorized to practise (i) in Alberta, or (ii) in Alberta or Saskatchewan, in the case of a resident of Alberta receiving medical services in Lloydminster. (2) The Minister shall pay for the costs of penicillin prescribed by a physician as a preventive measure against further medical complications as a result of having had Rheumatic Fever. AR 248/85 s6 6.1 (1) Notwithstanding sections 1 to 6, the Minister may, for the purposes of section 12 of the Public Health Act provide, or pay for all or part of the cost of providing, services, supplies, equipment, care, drugs, medicines and biological agents to persons who suffer from other severe medical conditions not referred to in sections 1 to 6. (2) The provision of or payment for services, supplies, equipment, care, drugs, medicines and biological agents under subsection (1) is subject to any terms and conditions the Minister may prescribe with respect to eligibility. AR 494/87 s2;17/99;251/2001 7 Alberta Regulations 69/74 and 250/74 are repealed. AR 248/85 s7 8 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on November 30, 2031.
