This regulation closes the road right-of-way portions listed in the Schedule.
Road Closure By-law Regulation, M.R. 3/2006 The Northern Affairs Act , C.C.S.M. c. N100 Regulation 3/2006 Registered January 10, 2006 bilingual version (HTML) WHEREAS The Northern Affairs Act provides in part as follows: 5(1) Subject to ... other provisions of the Act ... the minister has the powers, rights and privileges that a municipality has within its boundaries and the minister may exercise and perform these powers, rights and privileges. 5(5) [W]here the exercise or performance of the powers, rights, privileges or duties ... require the passing of a by-law ... the minister may make the by-law ... for or on behalf of the residents of Northern Manitoba .... 5(6) The by-law ... may be made to apply to the whole or any part of Northern Manitoba .... 111 Notwithstanding the repeal of The Municipal Act , R.S.M. 1988, c. M225, the provisions of that Act continue to apply to Northern Manitoba to the extent provided for in this Act immediately before the repeal of that Act and until this Act otherwise provides. AND WHEREAS The Municipal Act , R.S.M. 1988, c. M225, provides in part as follows: By-laws 215(1) Subject to subsections (2) and (3) the council of a municipality may pass by-laws ... (c) for closing any highway; or ... notwithstanding that the title to the land upon which the highway is situated is vested in the Government of Manitoba. AND WHEREAS it is considered advisable to close portions of the road right-of-ways described in the Schedule; NOW THEREFORE the Minister of Aboriginal and Northern Affairs enacts as follows: 1 Each road right-of-way, or portion of it, described in the Schedule is hereby closed. SCHEDULE Moose Lake 1 All those portions of Public Road Plan 5041 PLTO, NDIV, shown as Parcels A, B, C and D on a plan prepared by Dewey Michael Roger Hoplock of the City of Winnipeg, Manitoba Land Surveyor and sworn to by him on the 30th day of January, 2003, as same is shown on Deposit Plan 991/2002. ANNEXE Lac Moose 1 Les parties du plan de voie publique n o 5041 du B.T.F.P. (Div. de N), désignées comme parcelles A, B, C et D sur le plan qu'a dressé l'arpenteur-géomètre du Manitoba Dewey Michael Roger Hoplock, de la ville de Winnipeg, au Manitoba, et qu'il a certifié le 30 janvier 2003, lequel plan porte le numéro de dépôt 991/2002.
