Manitoba Telephone System Reorganization Miscellaneous Regulation, M.R. 3/97 The Manitoba Telephone System Reorganization and Consequential Amendments Act , S.M. 1996, c. 79 Regulation 3/97 Registered January 7, 1997 bilingual version (HTML) Definitions 1 In this regulation, "Act" means The Manitoba Telephone System Reorganization and Consequential Amendments Act . Corporation not a Crown or government agency 2 The corporation is deemed for all purposes not to be a Crown agency or a government agency. Definition of "government or agency thereof" 3 For the purposes of section 19 of the Act, "government or agency thereof" does not include a person or corporation or any other entity established or maintained to invest funds or other assets under a pension plan or under an insurance or annuity or other arrangement for the provision or payment of benefits in the form of (a) pensions, annuities, superannuation allowances or similar payments; or (b) allowances or similar payments upon the death, disability or temporary physical impairment of specified individuals. Definition of "person" 4 For the purposes of sections 21, 22, 25 and 26 of the Act, "person" includes a government and any agency thereof, other than the Crown and its agents. Easement agreements, caveats 5 For the purposes of subsection 28(2) of the Act, MTS NetCom Inc. is specified as the affiliate of the corporation to which the interests of the predecessor corporations in the right-of-way agreements, easement agreements and caveats referred to in that subsection have been assigned or transferred.
