"learner" means a person enrolled in an adult literacy program. (« apprenant ») "learning plan" means a plan, made by a learner and an organization that provides an adult literacy program, that sets out (a) the outcomes that the learner is expected to achieve by participating in the program; and (b) the supports that will be provided to the learner to achieve those outcomes. (« plan d'apprentissage ») "program year" means the consecutive 12-month period from July 1 to June 30. (« année de programme ») Funding applications 2 To apply for funding under the Manitoba Adult Literacy Program, an organization must provide the information required by the minister on the application form, including (a) the organization's name and address, and the address of every facility at which it provides an adult literacy program; (b) if the organization is a corporation, the names of the corporation's officers and directors and a copy of the latest annual return required to be filed under The Corporations Act ; (c) the name of the person responsible for the day to day operation of its adult literacy program; (d) a breakdown of each of its funding sources and proposed funding sources; (e) a proposed operating budget for the applicable program year containing an estimate of operating revenue and expenditures for its adult literacy program; (f) a copy of its adult literacy program admission policy; (g) a listing of all fees payable by a learner and the purpose for which each fee is charged; and (h) the number of people projected to become enrolled in its literacy program in the applicable program year. Organizations eligible for Manitoba Adult Literacy Program funding 3(1) To be eligible to receive funding under the Manitoba Adult Literacy Program, an organization must be a not-for-profit corporation, a library or an adult learning centre registered under The Adult Learning Centres Act and must satisfy the requirements in subsection (2). Requirements for eligible organizations 3(2) An organization referred to in subsection (1) must satisfy the minister that (a) the organization's admission policy is targeted at adults who have not regularly attended a high school in the 12 months prior to their enrollment in the organization's adult literacy program; (b) there are adults with a need for adult literacy programming within the area to be served by the organization; (c) the organization's literacy program will be responsive to the literacy needs of learners and will enable those learners to increase their literacy skills so that they are better able to pursue further education or employment opportunities, and to enhance their participation in the community; (d) in accordance with principles of adult education, the program will be delivered in one or a combination of both of the following manners: (i) in a group setting and in accordance with a schedule that reasonably facilitates a learner having available to them a minimum of six contact hours of instruction per week for a minimum of 26 weeks in the program year, (ii) by individual tutorials that provide sufficient contact hours to enable the learner to measurably increase their literacy skills in the program year; (e) the person responsible for the day to day operation of the literacy program, and the instructors, have the knowledge and skills necessary to perform their respective roles; and (f) the facility or facilities to be used to provide programming are appropriate to enable learners to achieve the outcomes set out in their respective learning plans. Ineligibility 3(3) Despite subsection (1), an organization is ineligible to receive funding under the Manitoba Adult Literacy Program if the organization charges or proposes to charge a learner (a) a tuition fee; or (b) a fee disclosed under clause 2(g) that, in the opinion of the minister, is not reasonable in the circumstances. Obligations of organizations that receive Manitoba Adult Literacy Program funding 4 An organization that receives funding under the Manitoba Adult Literacy Program must ensure that (a) at the time a learner enrolls in the organization's adult literacy program, (i) the learner completes an enrollment form that includes the learner's name and academic history, and (ii) the learner and the organization complete a learning plan for the learner; (b) each learning plan is regularly reviewed, and revised if required, so that it remains current with the learner's expected outcomes; (c) a learner file, which includes the learner's learning plan, is created and maintained for each learner, and the file is (i) stored in a secure manner, and (ii) accessible to the learner, or person authorized by the learner, at reasonable times; and (d) the learner, or person authorized by the learner, is provided any necessary assistance in interpreting the contents of the learner's file. Definitions 5(1) The following definitions apply in this section. "child abuse registry check" means a child abuse registry check under The Child and Family Services Act . (« relevé de vérification du registre concernant les mauvais traitements infligés aux enfants ») "criminal record check" means a record, including a vulnerable sector search, obtained from a law enforcement agency about a person stating (a) whether the person has a conviction or outstanding charge awaiting court disposition under any federal, provincial or territorial enactment; and (b) the details of any conviction or charge. (« relevé de vérification des antécédents judiciaires ») "facility" means a facility at which an organization provides an adult literacy program. (« établissement ») Child abuse registry and criminal record checks 5(2) If a facility has minors present, the organization must ensure that each staff person and volunteer who will work at the facility provides the organization with a criminal record check and child abuse registry check, dated within three months prior to commencing work at the facility. Record checks examined and maintained 5(3) The organization must ensure that the checks referred to in subsection (2) are (a) examined by the organization prior to the person commencing work at the facility (i) to determine if the person may be a risk to minors, and (ii) to assess the person's ability to discharge their responsibilities; and (b) maintained on the person's personnel record for as long as the person works at the facility. Further checks 5(4) If the organization receives information that causes it to believe that the person may pose a risk to minors or be unable to discharge the person's responsibilities, the organization may request that the person consent to a subsequent child abuse registry check and criminal record check. Subsection (3) applies with necessary changes when a further check is requested under this subsection. Interpretation —— minors 5(5) For the purpose of this section, a facility has minors present if (a) a person under 18 years of age is or may be enrolled in the adult literacy program at the facility; (b) the facility is (i) a school site, as that term is defined in subsection 1(1) of The Public Schools Act , (ii) a child care centre, as that term is defined in section 1 of The Community Child Care Standards Act , or (iii) a library; or (c) the organization provides care to a child of a learner while the learner is participating in the literacy program. Safety of learners 6 An organization may bar from program enrollment or attendance any learner whose behaviour detracts significantly from a safe and positive learning environment, or any learner who presents a threat or disruption to the safety of any other learner, staff person or volunteer. Recordkeeping and reporting 7 An organization that receives funding under the Manitoba Adult Literacy Program must (a) keep daily attendance records of learners in an approved form; (b) complete and file with the minister (i) statistical reports and records respecting learner demographics, attendance and outcomes, and (ii) financial reports, in the form and at the times required by the minister; and (c) within six months after the end of the organization's fiscal year during which the funding was received, provide the minister with a copy of the organization's audited financial statement for that fiscal year. Coming into force 8 This regulation comes into force on the same day that The Adult Literacy Act , S.M. 2024, c. 3, comes into force.
