"Act" means The Drivers and Vehicles Act . ( « Loi » ) "administrator" means The Manitoba Public Insurance Corporation in its capacity as administrator of the Act, as set out in section 2 of the Act. (« administrateur ») "anniversary date" , in relation to a person who holds or applies for an identification card, or applies for the renewal or reinstatement of an identification card, (a) means the day that annually is four months after the person's birthday; or (b) if the fourth month after the person's birth month does not contain a day with the same number as the number of the person's birthday, means the last day of the fourth month after the person's birth month. (« date anniversaire ») "separate driver's photo identification card" means a photo identification card issued as part of a person's driver's licence as required by clause 11(1)⁠(a) of the Act, as that clause read immediately before this regulation came into force. (« carte-photo d'identité distincte ») Name of cardholder 2 When the registrar issues an identification card, the registrar must issue it in the cardholder's full legal name or, if the name is incompatible with the computer system used to issue identification cards, in an alternative form of the name that the registrar determines to be compatible with the system. M.R. 116/2024 Issuing identification cards to drivers 3(1) The registrar must not issue an identification card to a person who holds a valid separate driver's photo identification card unless the person cancels and surrenders it before the identification card is issued. 3(2) Subsection (1) applies in respect of a person whether or not the driver's licence in relation to which the separate driver's photo identification card was issued is valid. 3(3) [Repealed] M.R. 50/2022 M.R. 50/2022 Issuing identification cards to children 4(1) The registrar may issue an identification card to a child but only in compliance with subsection (3). 4(2) [Repealed] M.R. 50/2022 4(3) The registrar must not issue an identification card to a child referred to in subsection (1) unless the application for the identification card and any consents required by the Act or by the registrar are signed (a) by one of the child's parents; (b) if the registrar is satisfied that the approval and signature of neither of the child's parents should be required, or if both of the parents are dead, by the child's legal guardian; or (c) in circumstances described in clause (b) but in which the child has no legal guardian, by any other person the registrar considers to be a responsible and suitable person. 4(4) [Repealed] M.R. 50/2022 4(5) The registrar may cancel a child's identification card if (a) the registrar receives a written cancellation request from a person who is eligible under this section to consent to the identification card being issued to the child; and (b) the registrar considers that it is appropriate to cancel the identification card. M.R. 212/2009 ; 50/2022 5 [Repealed] M.R. 50/2022 6 [Repealed] M.R. 36/2013 ; 50/2022 ; 7/2025 7 [Repealed] M.R. 36/2013 ; 50/2022 8 [Repealed] M.R. 43/2015 ; 34/2016 ; 50/2022 ; 7/2025 Exemptions from photo requirements 9 A person is exempt from the requirement to be photographed for an identification card if (a) being photographed is contrary to a bona fide obligation of the religious faith to which the person subscribes and the person provides evidence verified by their affidavit and supported by a letter signed by a member of the clergy or religious faith that (i) the person is a member of the religious faith, and (ii) it is contrary to a bona fide obligation of that faith to have their photo taken; or (b) the registrar is satisfied that the person (i) is not reasonably able to present themselves to be photographed, or (ii) ought not on humanitarian grounds to be required to be photographed. M.R. 50/2022 Period of validity of identification card 10(1) The period of validity of an identification card (a) must not exceed 62 months; (b) begins on the day that the identification card is issued; and (c) ends on the expiry date set out in the identification card. 10(2) Subject to subsection (3) and section 11, the expiry date of an identification card must be the day before the last anniversary date of the person to whom the card is issued occurring within the 62-month period after the identification card is issued. 10(3) The following rules apply with respect to the expiry date of an identification card that is issued to a person who is temporarily entitled to be in Canada under a study permit, work permit or visitor record issued under the Immigration and Refugee Protection Act (Canada): 1. If the study permit, work permit or visitor record of the person applying for the identification card expires less than 62 months after the application date, the expiry date of the person's identification card must be the same as the expiry date of the study permit, work permit or visitor record. 2. If the study permit, work permit or visitor record of the person applying for the identification card expires 62 months or more after the application date, the expiry date of the person's identification card must be as set out in subsection (2). M.R. 50/2022 10.1 [Repealed] M.R. 105/2016 10.2 [Repealed] M.R. 139/2024 10.3 [Repealed] M.R. 53/2025 10.4 [Repealed] M.R. 98/2025 Coordination of expiry dates 11 Despite subsections 10(2) and (3), the registrar may, when he or she issues a person's identification card, choose a different expiry date that the registrar considers necessary for the efficient administration of the identification card, driver licensing and vehicle registration systems. 12 [Repealed] M.R. 50/2022 When an identification card may be replaced 13 If a person's identification card is lost, is destroyed or is damaged so as to be unusable, he or she may request a replacement only if (a) the identification card has not expired, is not suspended and has not been cancelled; and (b) the person continues to be eligible for the identification card. 14 [Repealed] M.R. 50/2022 15 [Repealed] M.R. 50/2022 16 [Repealed] M.R. 50/2022 Refusing to issue an identification card 17(1) The registrar may refuse to issue an identification card to a person if the registrar has reason to believe, based on the person's past conduct or offences committed by him or her, that (a) the person has a history of using his or her identification card other than in accordance with the Act or of committing offences with or in relation to his or her identification card; and (b) the person is likely to use the identification card other than in accordance with the Act, or to commit an offence with or in relation to the identification card, if it is issued. 17(2) The registrar may continue to refuse for a period of up to one year taking into account the person's history of misusing his or her identification card or committing offences with or in relation to it. 17(3) Within six months after the date of a decision by the registrar to refuse to issue an identification card under this section, the decision may be appealed to the appeal board as provided in section 279 of The Highway Traffic Act . M.R. 50/2022 Suspending or cancelling an identification card 18(1) The registrar may, without notice and for any period the registrar considers appropriate, suspend or cancel a person's identification card if the registrar has reason to believe (a) that (i) the person is not old enough to hold an identification card, (ii) the person's full legal name is not the name that the person gave in his or her application for the identification card, (iii) the person's birth date is not the birth date set out in the identification card, (iv) the person's address is not the address set out in the identification card, (v) the person is not a resident of Manitoba, or (vi) the person is not entitled to be in Canada for the period in respect of which the identification card was issued; or (b) that subsection 17(1) applies in respect of the person. 18(2) Subject to subsection (3), the registrar's decision to suspend or cancel an identification card for a reason set out in clause (1)⁠(a) is final and not subject to appeal. 18(3) If the registrar suspends or cancels a person's identification card for a reason set out in clause (1)⁠(a), the person may ask the registrar to review the decision. The registrar must then review the decision and give the person a written notice stating the results of the review. 18(4) Within six months after the date of a decision by the registrar to suspend or cancel an identification card for a reason set out in clause (1)⁠(b), the decision may be appealed to the appeal board as provided in section 279 of The Highway Traffic Act . M.R. 50/2022 Registrar's review of a decision 19 For the purposes of subsection 150.7(6) of the Act and of subsection 18(3) of this regulation, (a) a person who wishes to have the registrar review a decision made under subsection 150.7(1) of the Act or under clause 18(1)⁠(a) of this regulation must (i) ask for the review and state the reasons for it in a notice in writing, and (ii) give the notice to the registrar; and (b) after receiving the notice, the registrar must without delay (i) have the decision reviewed by an employee of the administrator who (A) must be independent of the original decision maker, and (B) may decide to confirm the original decision or to make another decision that the original decision maker could have made in the circumstances, and (ii) give the person notice of the decision resulting from the review and the reasons for it. Seniors who surrender their drivers' licences 20(1) When a person who is 65 years of age or more voluntarily surrenders his or her driver's licence, the registrar must, without charge, issue an identification card to the person if he or she requests it at the time the driver's licence is surrendered. 20(2) The expiry date of an identification card issued under subsection (1) must be the same as the expiry date of the surrendered licence. 20(3) and (4) [Repealed] M.R. 50/2022 20(5) Subsection (1) applies only if the person meets the eligibility requirements for an identification card. M.R. 212/2009 ; 50/2022 21 and 22 [Repealed] M.R. 50/2022 Coming into force 23 This regulation comes into force on the same day that section 33 of The Drivers and Vehicles Amendment, Highway Traffic Amendment and Manitoba Public Insurance Corporation Amendment Act , S.M. 2008, c. 36, comes into force.
