This regulation defines terms, sets certain prescribed dollar amounts, sets a minimum interest rate for holdbacks, and states when the regulation comes into force.

"Act" means The Transportation Infrastructure Act . («  Loi  ») "agricultural use" means use for the primary purpose of (a) growing crops or fodder for use or for sale; (b) raising livestock or poultry for sale; (c) operating a poultry establishment for the production of eggs for sale; (d) operating a mink or fox establishment maintained for their pelts for sale or for sale as breeding stock; (e) operating a dairy establishment maintained for the production of milk or cream for sale; (f) operating a feed lot upon which cattle are kept or fed for marketing; (g) operating an apiary of hives of bees maintained for the production of honey for sale. (« usage agricole ») "billboard sign" means a sign other than a portable sign. (« panneau-réclame ») "commercial use" means use for the primary purpose of conducting (a) a commercial activity; or (b) a not-for-profit activity that is not a public use. (« usage commercial ») "portable sign" means a sign that (a) is designed to be moveable and intended for temporary installation; or (b) is designed to be permanently mounted and (i) is erected wholly on an applicant's land, or (ii) does not exceed 8 m 2 in surface area. (« panneau portatif ») "prime lending rate" means the prime lending rate of the Royal Bank of Canada. (« taux préférentiel ») "public use" means use for the primary purpose of (a) local government administration; (b) emergency services; (c) community services; (d) operating a place of worship; (e) operating an educational institution; (f) operating a community centre; or (g) operating a registered charity as defined in subsection 248(1) of the Income Tax Act (Canada). (« usage public ») "residential use" means use for the primary purpose of single residential or multi-residential occupancy. (« usage résidentiel ») "utility" means equipment operated for the primary purpose of supplying electricity, natural gas, oil and petroleum products, telecommunications, water or wastewater services. (« équipement ») M.R. 6/2022 CONTRACTS Forgoing the lowest compliant bid 2 For the purpose of clause 9(3)⁠(b) of the Act (forgoing the lowest compliant bid), the amount prescribed is $50,000. Rate of interest on holdbacks 3(1) Subject to subsection (2), the interest payable on holdbacks under subsection 10(3) of the Act is the prime lending rate less 4%, adjusted on January 1 and July 1 of each year and determined as follows: (a) for a January 1 interest adjustment, the interest rate is calculated based on the prime lending rate in effect the previous December 1; (b) for a July 1 interest adjustment, the interest rate is calculated based on the prime lending rate in effect the previous June 1. 3(2) If the interest rate calculated in accordance with subsection (1) is less than 0.5%, the interest rate payable on the holdback is 0.5%. Authorization for real property leases 4 For the purpose of clause 13.1(3)⁠(a) of the Act (authorization of certain leases), the prescribed amount is $25,000. M.R. 79/2022 Authorization for disposal of personal property 4.1 For the purpose of section 13.3 of the Act (disposal of personal property), the prescribed amount in relation to the sale of personal property is $25,000. M.R. 79/2022 FEES Permit Application Fees 5 The following fees are prescribed for the purposes of the Act: (a) portable sign permit COMING INTO FORCE Coming into force 6 This regulation comes into force on the same day that Schedule A of The Traffic and Transportation Modernization Act , S.M. 2018, c. 10, comes into force.
