"Act" means The Child and Family Services Act . («  Loi  ») "authority" means a child and family services authority established under The Child and Family Services Authorities Act . (« régie ») Reference to "mandating authority" 1(2) In relation to an agency, a reference to the "mandating authority" means the authority that has mandated, or is deemed to have mandated, that agency under Part I of The Child and Family Services Act . M.R. 104/2003 ; 180/2003 PART 2 AGENCY STAFF Definitions 2 In this Part, "criminal record check" means a record obtained from a law enforcement agency about a person stating whether or not the person has any conviction or has any outstanding charge awaiting court disposition under any federal or provincial enactment; (« relevé des antécédents judiciaires ») "prior contact check" means a record about a person referred to in clause 3(1)⁠(c). (« relevé des contacts antérieurs ») M.R. 205/2001 ; 104/2003 Child abuse registry, criminal record and prior contact checks 3(1) An agency shall ensure that for any person who provides work or services to the agency, whether as an employee, volunteer, student trainee or in any other way, or any person who applies or proposes to provide such work or services to the agency, the following checks are obtained with respect to the person: (a) a child abuse registry check; (b) a criminal record check; (c) a prior contact check, only if the check is for a person to whom subsection 18(1) of the Foster Homes Licensing Regulation , Manitoba Regulation 18/99, applies, obtained in accordance with that regulation. Date of checks 3(2) A check referred to in subsection (1) must be dated within three months prior to the date when the person commences providing work or services to the agency or applies or proposes to do so. Checks reviewed by the agency 3(3) The agency shall review the checks referred to in subsection (1) and must be satisfied that the person (a) does not pose a risk to children; and (b) is able to discharge his or her responsibilities. Requiring further checks 3(4) Where the agency, the mandating authority or the director receives information that causes it to believe that the person may pose a risk to children or be unable to discharge his or her responsibilities, the agency, the mandating authority or the director may request that the person consent to a subsequent child abuse registry check and a criminal record check. Further checks reviewed 3(5) Subsection (3) applies with necessary modifications when a further check is requested under subsection (4). M.R. 205/2001 ; 180/2003 Qualifications of agency contract staff 4 An agency shall ensure that a person who provides work or services to the agency on a contract basis meets the same qualifications as to education and experience as met by an employee of the agency who performs similar duties. PART 3 SERVICES TO FAMILIES Special needs services 5(1) The following supportive and treatment services are prescribed for the purpose of subsection 10(1) of the Act: (a) family and community education and information; (b) referral to an appropriate community support program or specialized service; (c) family support and preservation; (d) other services to prevent family disruption or restore family functioning. Condition re agency purchasing services 5(2) An agency shall not (a) agree to purchase a service on behalf of a client unless that client is ordinarily required to pay or be charged for that service; or (b) pay for a service for which a client is not required to pay. Types of emergency assistance 5(3) The following items are prescribed as emergency financial and material assistance for the purpose of subsection 10(2) of the Act: (a) food; (b) clothing; (c) transportation; (d) other assistance as may be required to alleviate immediate need. Emergency assistance 5(4) An agency may provide emergency financial and material assistance only where (a) income assistance, general assistance or municipal assistance under The Manitoba Assistance Act or disability support under The Disability Support Act ; or (b) income assistance provided to members of Indian bands; is not immediately available. M.R. 89/2024 Day care services 6(1) Where in the course of providing services to a family, an agency, in consultation with the parent or guardian of a child, agrees to the need for day care services for the child and (a) a day care facility licensed under The Community Child Care Standards Act is not available or accessible; and (b) the child is at risk of having to be placed outside the home either through a kinship care agreement, customary care agreement or voluntary care agreement or by apprehension; the agency may enter into an agreement under section 12 of the Act with the parent or guardian for the provision of day care services for the child and place the child in a suitable alternative to a licensed day care facility. Suitable alternative 6(2) An agency shall not place a child in an alternative to a licensed day care facility unless (a) the alternative facility only provides care to less than five children and not more than two of the children are less than two years of age; and (b) the agency is satisfied that the alternative facility is suitable and can provide (i) an environment conducive to the health, safety and well-being of the child, and (ii) a program of activities to promote the overall development of the child including the child's physical, social, emotional and intellectual growth. M.R. 5/2020 ; 89/2024 Parental contribution for maintenance of child 7(1) Where a parent or guardian executes an agreement with respect to (a) the placement of a child for day care under section 12 of the Act; or (b) the placement of a homemaker or parent aide in the home, under section 13 of the Act, to care for or assist in caring for the child; (c) [repealed] M.R. 89/2024 ; the parent or guardian shall, at the request of the agency, complete and sign the Declaration of Family Income, Form CFS-10 in Schedule A with respect to the financial information of the parent or guardian with whom the child primarily lives. Maintenance payable 7(2) For the purpose of subsection 15(2) of the Act and subject to subsection 15(3) of the Act, the amount of maintenance to be paid by a parent or guardian with respect to an agreement under section 12 or 13 of the Act shall be the lesser of (a) the actual cost of the maintenance payable for the child; and (b) the amount of the fee determined in accordance with Schedule B (Calculation of Parental Contribution). Waiver of maintenance fee 7(3) A parent or guardian entering into an agreement under section 12 or 13 of the Act is not required to contribute under subsection (2) where (a) the parent or guardian receives income assistance, general assistance or municipal assistance under The Manitoba Assistance Act , disability support under The Disability Support Act or income assistance from an Indian band; or (b) with respect to a child day care agreement under section 12 of the Act or a family support services agreement under section 13 of the Act, family income is equal to or less than the maximum family income amount for the size of the family as set out in Range 19 of the Calculation of Parental Contribution Table or calculated according to the Calculation Formulas, as set out in Schedule B; (c) [repealed] M.R. 89/2024 . M.R. 5/2020 ; 89/2024 PART 4 AGENCY RECORDS Definition of "agency record" 8(1) In this Part, "agency record" means a record made under the Act that is in the custody or control of an agency . Application 8(2) This Part applies to agency records. Duty to adopt security safeguards 9(1) Subject to the provisions of the Act and the standards established by the director, an agency shall ensure that the information in an agency record is (a) protected by the agency adopting reasonable administrative, technical and physical safeguards that ensure the confidentiality, security, accuracy and integrity of the information; and (b) accessible only to persons employed, retained or consulted by the agency and only when access to the record is needed to carry out their responsibilities under the Act in relation to the person to whom the record relates. Closed child in care records 9(2) Where an agency is allowed access to a record referred to in subsection 76(14) of the Act, the agency shall ensure that information from the record is disclosed only with the written authorization of the executive director or regional director of the agency or his or her delegate. M.R. 180/2003 Retention of agency records 10 An agency shall ensure that on completion of a service, the agency record is (a) closed in accordance with procedures established by the director; and (b) retained by the agency for the period of time and in the manner established by the director in order to (i) ensure that the subject of the agency record has a reasonable opportunity to obtain information from the record as permitted under the Act, and (ii) assist the agency in providing services under the Act. Destruction of agency records 11(1) An agency shall ensure that an agency record is destroyed (a) in accordance with procedures established by the director; and (b) in a manner that protects the privacy of the person to whom the record relates. Record of destruction 11(2) An agency that destroys an agency record shall keep a record of (a) the person whose record is destroyed and the time period to which the record relates; and (b) the method of destruction and the person responsible for supervising the destruction. PART 4.1 CHILD ABUSE REGISTRY CHECK FEES Fees 11.1(1) Subject to subsection (2), a person, agency, adoption agency or organization applying for a child abuse registry check must pay a fee in the amount of $20. The fee for each additional check requested in the same application is $5. Exemptions 11.1(2) No fee is payable for any of the following applications for a child abuse registry check: (a) an application made by an agency under clause 19.3(2)⁠(a) of the Act; (b) an application to assess an adoptive applicant made by an agency under clause 19.3(2)⁠(c) of the Act or by an adoption agency under clause 19.3(2.1)⁠(a) of the Act; (c) an application made by a person, agency, adoption agency or organization under subsection 19.3(3.1) of the Act to assess a person whose work is unpaid; (d) an application made by a person, agency, adoption agency or organization to assess a person who is a student trainee or in a work placement program; (e) an application to assess an applicant for a licence under the Foster Homes Licensing Regulation ; (f) an application made by a peace officer under subsection 19.3(3) of the Act; (g) an application made by the Advocate or one of his or her employees for the purpose of carrying out the Advocate's duties under the Act; (h) an application made by the chief medical examiner or one of his or her employees for the purpose of carrying out the duties of a medical examiner under The Fatality Inquiries Act . M.R. 104/2003 ; 124/2012 ; 116/2017 ; 89/2024 PART 5 FORMS Forms 12 The forms set out in Schedule A are prescribed for use under Parts I, II, III and IV of the Act. PART 6 REVIEW, REPEAL AND COMING INTO FORCE Review 13 Not later than March 14, 2004, the minister shall (a) review the operation of this regulation including consulting with such persons affected by it as the minister considers appropriate; and (b) if the minister considers it advisable, recommend to the Lieutenant Governor in Council that the regulation be amended or repealed. Repeal of Manitoba Regulation 57/86 14(1) The Child and Family Services Forms Regulation , Manitoba Regulation 57/86, is repealed, except for Forms 26 to 38. Manitoba Regulation 59/86 repealed 14(2) Manitoba Regulation 59/86 is repealed. Coming into force 15 This regulation comes into force on March 15, 1999. The table contains separate fee schedules for children in care and family services. The fee schedule for family services applies to child day care agreements and family support (homemaker and parent aide) services under sections 12 and 13 of the Act respectively. 2. The table consists of 131 income ranges. Each range contains maximum family income amounts for that range depending on family size. There are six columns for families from two to seven or more members. For example, for a family with two members, Range 3 includes incomes from $20,922 to $21,921. Family income refers to the total income declared on Form CFS-10, Declaration of Family Income. 3. The maximum family income amounts in the first range (Range 1) are based on annualized income assistance rates for each family size under The Manitoba Assistance Act , which came into force on July 1, 1998. The maximum income amount of $20,921 in the second range (Range 2) for a family with two members is the point at which the Canada Child Tax Benefit (effective July 1, 1998) begins to reduce. Beginning with Range 2, maximum family size income columns increase by increments of $1,425 for each additional child. This amount is the equivalent of the annual maximum Canada Child Tax Benefit for each additional child. 4. Beginning with Range 3, the ranges escalate at $1000 increments to a maximum family income of $149,921 for a family with two members and a maximum family income of $157,046 for a family of seven members. 5. Where there are more than seven family members or where the total adjusted annual family income is more than the amount in range 131 for the family size, an agency shall determine the amount of the parental contribution based on the calculation formulas provided in this Schedule. M.R. 89/2024 ; 115/2025 Instructions in Use of Table 1. Parental contribution calculations under section 7 of the regulation are based on the Declaration of Family Income (Form CFS-10) completed and signed by a parent or guardian entering into an agreement under section 12 or 13 of the Act subject to a verification of income by the agency. 2. The table is used to calculate maintenance payable by a parent or guardian under section 7 of the regulation where there are no more than seven family members and where the total adjusted annual family income does not exceed the amount in Range 131. 3. The table is not used to determine the amount of the child in care or family service fee, as the case may be, where the actual cost of services is equal to or less than the amount calculated by the table. 4. [Repealed] M.R. 89/2024 5. In calculating the amount of a family service fee under section 12 or 13 of the Act, the agency shall determine a daily or hourly rate according to the table. M.R. 89/2024 Calculation Formulas 1. Where there are more than seven family members, the maximum amount of family income for each range is calculated by adding $1,425 for each additional family member. 2. Where the total adjusted annual family income is more than the amount for the family size in Range 131 of the table, the amount of the child in care fee is calculated through the following steps: A. Subtract the maximum amount of family income for family size in Range 131 from the total adjusted annual family income. B. For each $1,000 or portion thereof the total adjusted annual family income exceeds the amount for family size in Range 131, add the following amounts: $13.50 for the first child under 11 years of age; $16.50 for the first child 11 years of age or older; $10.12 for each remaining children under 11 years of age; and $12.38 for each remaining children 11 years of age or older. 3. Where the total adjusted annual family income is more than the amount for family size in Range 131 of the table, the amount of family service fee is calculated as follows: A. Add $0.40 per day or $0.05 per hour to the amount of the fee for each $1,000 or portion the total adjusted annual family income exceeds the amount for family size in Range 131.
