"Act" means The Emergency Medical Response and Stretcher Transportation Act . («  Loi  ») "facility" has the meaning assigned by section 1 of The Regional Health Authorities Act . (« établissement ») "health region" means a health region established or continued under The Regional Health Authorities Act . (« région sanitaire ») "licence holder" means the holder of a licence to operate a stretcher transportation service. (« titulaire de permis ») "regional health authority" means a regional health authority established or continued under The Regional Health Authorities Act. (« office régional de la santé ») "trained escort" means an individual who has the training and experience to provide care and assist an individual with his or her required assistive devices during transport, but does not include a licensed stretcher attendant. (« accompagnateur compétent ») Stretcher transportation services 2 For the purpose of this regulation "stretcher transportation services" includes the following: (a) assisting an individual onto and off of a stretcher using appropriate techniques; (b) securing an individual to a stretcher and loading the stretcher into a stretcher transportation vehicle; (c) safely transporting the individual and equipment; (d) monitoring the individual during transport and providing assistance during transport; (e) safely unloading the individual at his or her destination, and if applicable, transferring care of the individual to a responsible person at that destination. PART 2 STRETCHER TRANSPORT SERVICES Applications and Renewal of Licences Stretcher transportation service licence application 3(1) An applicant may, in the form and manner specified by the minister, apply to the minister to become a licence holder. 3(2) An application must include (a) if the applicant is incorporated under The Corporations Act , the names and addresses of the directors and officers of the corporation; (b) if the applicant is other than a corporation, the name and address of the owner, or if the applicant is a partnership, the names and addresses of all general partners in the partnership; (c) the municipal address and the mailing address of all the premises from which the applicant proposes to operate the stretcher transportation service; (d) evidence that the applicant has obtained liability insurance, as specified in section 14; (d.1) evidence that the stretcher attendants employed or engaged by the licence holder meet the requirements set out in this regulation; and (e) any other information or documentation that the minister considers necessary to determine the ability of the person to operate the stretcher transportation service. M.R. 114/2020 Issuance of licence 4 A licence to operate a stretcher transportation service may not be issued unless the minister is satisfied that the applicant has satisfactorily demonstrated it can adequately operate the stretcher transportation service. Expiry and renewal of a licence 5(1) Unless renewed, a licence issued under this Part expires on December 31 of the year in which it is issued, or such shorter period as the minister may determine. 5(2) To renew its licence, a licence holder must submit an application for renewal at least 90 days before the expiry date of the licence, and the application must (a) be in the form approved by the minister; and (b) include the information and documentation that the minister considers necessary to determine the ability of the licence holder to continue to operate the stretcher transportation service. Agreements Before Commencement of Operations Agreement 6(1) A licence holder must not provide stretcher transportation services to or from a facility without first entering into a written agreement with Shared Health Inc. 6(2) A licence holder must not operate stretcher transportation services inconsistent with the terms of an agreement entered into under subsection (1). M.R. 96/2019 Stretcher Transportation Vehicles Requirements for vehicles providing services 7 A licence holder must ensure every stretcher transportation vehicle used to provide stretcher transportation services (a) is maintained in a mechanically safe condition; (b) complies with vehicle specifications approved by the minister; and (c) carries functioning communications equipment capable of contacting an emergency medical response system from any point in the working area of the vehicle. Annual inspection 8(1) Before January 31 of each year, a licence holder must have a vehicle safety inspection completed on every stretcher transportation vehicle used to provide stretcher transportation services and the results of every inspection must be filed with the minister. 8(2) A licence holder may only use a stretcher transportation vehicle if it satisfactorily completes the vehicle safety inspection required in subsection (1). Individual care supplies 9(1) A licence holder must ensure every stretcher transportation vehicle carries the individual care supplies set out in the Schedule. 9(2) A trained escort may bring assistive devices and supplies not listed in the Schedule for the purpose of assisting the individual being transported. 9(3) A licence holder must ensure that a stretcher transportation vehicle only carries individual care equipment permitted under this section. Operations Staffing of stretcher transportation vehicle 10 A licence holder must ensure every stretcher transportation vehicle used to provide stretcher transportation services has a crew of at least two stretcher attendants. M.R. 114/2020 Limitations re transporting individuals 11(1) A licence holder may transport an individual only if (a) the individual requires no assistance, other than the stretcher transportation services described in section 2; and (b) the transportation is (i) arranged by a facility, (ii) done pursuant to a written order signed by a physician, nurse or other recognized care provider for the individual, or (iii) determined to be appropriate for stretcher transportation services by a licensed emergency response medical services dispatch centre. 11(2) Where an individual is transported pursuant to a written order as referred to in subclause (1)⁠(b)⁠(ii), a copy of the order must be (a) received by the licence holder before transport; and (b) retained on file by the licence holder. Requirement to contact emergency medical response system 12 The stretcher attendant must, if it is determined during transport that the individual being transported requires urgent medical intervention, (a) ensure that the appropriate emergency medical response system is immediately contacted; and (b) follow the instructions provided by that emergency medical response system. Infection control 13 A licence holder must (a) ensure that when a stretcher transportation vehicle is used to transport an individual with a known or suspected contagious disease, the vehicle is not used (i) at the same time to transport another individual who does not have the disease, or (ii) thereafter to transport any other individual without first disinfecting the vehicle in accordance with guidelines approved by the minister; and (b) implement an infection control program approved by the minister. Insurance requirements 14 Except where the minister is satisfied that a licence holder is adequately self-insured, a license holder must have (a) insurance which insures every stretcher transportation vehicle in an amount of at least $2,000,000 in respect of liability arising from bodily injury to or the death of any individual being transported; and (b) commercial liability and error and omissions insurance in respect of the provision of stretcher transportation services in an amount of at least $5,000,000. M.R. 114/2020 Smoking prohibited 15 No individual may smoke or use an e-cigarette, as defined in The Smoking and Vapour Products Control Act , in a stretcher transportation vehicle at any time. M.R. 114/2020 Reports Collision or fire 16(1) A licence holder must file a report with the minister in the event a stretcher transportation vehicle is involved in a collision or fire (a) while transporting an individual; (b) that results in an employee, escort or a member of the public being injured; or (c) that is required under The Highway Traffic Act to be reported to a peace officer. 16(2) Subject to doing what is necessary for public safety, a licence holder must notify the minister before removing the contents of the stretcher transportation vehicle and before commencing any repairs to it, so as to allow an investigation of the incident and an assessment of the performance of designed safety features of the vehicle. Transport reports 17(1) A licence holder must ensure that a transport report is completed by the stretcher attendant immediately after the transportation of an individual. 17(2) A licence holder must retain every transport report, and must provide a copy of a report or excerpt from it to the minister on the minister's request. 17(3) A licence holder must (a) retain every original transport report for a period of seven years from the date of the transport, or for such longer period as is otherwise required by law; and (b) store and dispose of reports and other confidential information relating to individuals who were transported in accordance with security measures acceptable to the minister. M.R. 96/2019 Reports about occurrences 18(1) A licence holder that is not a regional health authority or Shared Health Inc. must provide to Shared Health Inc. reports about occurrences in or related to stretcher transportation services that have resulted in actual or potential (a) loss of life, limb or function; (b) loss or damage to property; or (c) harm or risk not described in clause (a) or (b); in accordance with the policy approved by Shared Health Inc. 18(2) Shared Health Inc. must provide to the minister reports about occurrences in or related to stretcher transportation services that have resulted in actual or potential (a) loss of life, limb or function; (b) loss or damage to property; or (c) harm or risk not described in clause (a) or (b); in accordance with the policy approved by the minister. M.R. 96/2019 Other reports 19 A licence holder must report any other information the minister requires from time to time. Form and timing for filing reports 20 A report required under sections 16 to 19 must be filed in the time, form and manner specified by the minister. PART 3 PERSONNEL Minimum qualifications of stretcher attendants 21 An individual may act as a stretcher attendant without a licence issued under the Act if the individual (a) is a minimum of 18 years of age; (b) has successfully completed a first aid and cardiopulmonary resuscitation course consisting of at least 16 hours of in-class instruction, as approved by the minister, within the 12 months immediately preceding the day on which the individual begins working as a stretcher attendant; and (c) maintains a valid certification for standard first aid or level two occupational first aid throughout their employment as a stretcher attendant. M.R. 114/2020 22 and 23 [Repealed] M.R. 114/2020 Performance of procedures and functions 24 A licence holder must ensure that all stretcher attendants employed or engaged by the licence holder meet the requirements set out in section 21. M.R. 114/2020 PART 4 TRANSITIONAL PROVISIONS 25 and 26 [Repealed] M.R. 114/2020 27(1) and (2) [Repealed] M.R. 114/2020 27(3) If the minister is satisfied that it is impractical or impossible to adapt a stretcher transportation vehicle to comply with the provisions of this regulation, the minister may permit the vehicle to continue to be used by a licence holder, subject to such terms and conditions on its use that the minister may prescribe. M.R. 114/2020 PART 5 COMING INTO FORCE Coming into force 28 This regulation comes into force on the same day that The Ambulance Services Amendment Act , S.M. 1996, c. 42, comes into force. SCHEDULE (section 9) INDIVIDUAL CARE SUPPLIES The column "Minimum Req'd" refers to the quantity of each item and does not limit the stretcher transportation services operation from stocking additional quantities of that item. Each item stocked must comply with the description in the "Specifications" column and be maintained in a clean, sanitary condition, in proper working order and in accordance with the manufacturers' instructions and standards. Item Minimum Req'd Specifications 1 Main cot 1 Multi-level cot with separately elevating head section, and non-porous mattress. Cot must be designed to fit in a cot-retention bracket approved by the minister. Must be equipped with safety restraining straps of a design which secure the individual to the cot in the event of impact. 2 Oxygen tank 2 or more tanks totalling a minimum of 600 L Vehicle must maintain at minimum 325 L of oxygen supply. Note: one D cylinder must be removable for transfer outside vehicle. 3 Suction device 1 installed suction device Securely mounting medical suction device. 4 Sheets 4 Polyester-cotton blend or equivalent. 5 Pillows 2 Hypoallergenic with moisture-proof coverings. 6 Thermal protection 2 Blankets, cover sheets, etc. Appropriate size for adult use. Hypoallergenic fibres. 7 Individual comfort devices 1 box Facial tissues 1 Bedpan 1 Urinal 1 Kidney basin 8 Protective equipment for personnel 1 box Latex (or equiv.) gloves, disposable, single use, to protect caregiver from blood and body fluids during contact with individual being transported. As acceptable to the minister. 4 Masks. 3 Outer garment to protect caregiver from blood and body fluids. As acceptable to the minister. 1 Commercial antimicrobial preparation in spray, liquid or handwash towelette form. Minimum 4 oz/10 applications. 9 Cleansing/ Disinfection equipment 1 kit Adequate supply of cleansers/disinfectants, applicators, etc. as outlined in the "Infection Control Program" and as acceptable to the minister. 10 Barrier device for artificial ventilation 1 per vehicle Clear mask with one-way valve and extension tube. 11 Cardiac board 1 Rigid device for placement under torso during CPR.
