W130 Regulation 26/88 R Registered January 15, 1988 bilingual version (HTML) 1 [Repealed] M.R. 145/90 2 A person claiming compensation, under section 88 of the Act, for livestock killed or injured by another person during an open big game season, shall (a) forthwith report the occurrence to the nearest Royal Canadian Mounted Police detachment or district office of the department; and (b) not later than 30 days following the discovery of the killing or injuring, which date must not be later than 30 days after the close of the big game season in the area in which the killing or injuring occurred, apply to the minister in writing for payment of compensation. M.R. 4/99; 115/2025 3 The application under clause 2(b) shall be accompanied by an affidavit or statutory declaration, duly completed by the applicant, showing (a) the full name, address and occupation of the applicant; (b) the date, place and legal description of the land where the livestock was found killed or injured; (c) the value of the livestock immediately prior to the time it was killed, or in the case of injury, a signed statement from a licenced veterinarian as to the amount of veterinarian's fees paid to restore the injured livestock to health; (d) the salvage value, if any; (e) the amount of compensation claimed; (f) that the amount claimed is fair and reasonable; (g) if known to the applicant, the name and address of the person responsible for the killing or injuring, and what steps if any have been taken to recover compensation from that person; and (h) whether the animal was covered by insurance, and if so, the amount for which it was covered. 4 Prior to making an award of compensation under section 88 of the Act, the minister shall consider the following: (a) the affidavit or statutory declaration under section 3; (b) in the case of killed livestock, the opinion of the Department of Agriculture with respect to the fair and reasonable value of the livestock immediately prior to the time it was killed; (c) in the case of injured or killed livestock, the opinion of the Department of Agriculture, with respect to the fair and reasonable value of veterinarian's fees incurred to restore the injured livestock to health, or to treat the killed livestock prior to its death; (d) the amount claimed or received by the applicant for salvage or from an insurance claim.
