(« année d'inscription ») PRACTICAL NURSING EDUCATION PROGRAMS Requirements of a practical nursing education program 2 The board may approve a program as a practical nursing education program if the board is satisfied that it (a) provides graduates with the competencies set out in the document entitled Scope of Practice — Entry Level Competencies , that was approved by the board of the Manitoba Association of Licensed Practical Nurses in July 2001; and (b) meets the standards for a practical nursing education program described in Schedule A. EQUIVALENT EXAMINATION Equivalent examination 3 The board may approve an examination as being equivalent to the Canadian Practical Nurses Registration Exam. REGISTERS Registers of temporary practising licensed practical nurses and advanced licensed practical nurses 4(1) In addition to the registers of practising licensed practical nurses, graduate practical nurses and students referred to in subsection 7(1) of the Act, the executive director shall maintain registers of temporary practising licensed practical nurses and advanced licensed practical nurses. 4(2) The registers of temporary practising licensed practical nurses and advanced licensed practical nurses must contain the information required by clauses 7(2)⁠(a) to (d) of the Act. 4(3) The register of students must contain (a) the name, home address and home telephone number of every student enrolled in a practical nursing education program, practical nursing completer program or practical nursing refresher program; (b) the name and address of the educational institution at which the student is enrolled; (c) information as to whether the student is enrolled full-time or part-time at the educational institution; and (d) the student number assigned to the student by the educational institution. Information on registers 5(1) For the purposes of clause 7(2)⁠(e) of the Act, the following additional information is to be included in each register for each member: (a) the member's registration number; (b) the date and type of registration; (c) the date of any reinstatement or conversion of registration; (d) the member's gender; (e) the member's date of birth; (f) the member's home address and telephone number; (g) particulars of the member's education, including the name of the institution from which the member graduated, and the date of graduation; (h) information as to whether registration was granted on the basis of examination or endorsement; (i) updates relating to additional education completed; (j) if the member is registered in any other jurisdiction, details of that registration. Public information 5(2) The information referred to in subsection (1), other than the information referred to in clauses (1)⁠(d), (e) and (f), is designated as public information for the purpose of clause 7(3)⁠(d) of the Act. Verification of registration status 5(3) At the request of a member, upon payment of the fee set out in the by-laws, the executive director shall send verification of the member's registration status to another jurisdiction, an educational institution, an employer or another person specified by the member. REGISTRATION AS A LICENSED PRACTICAL NURSE Eligibility for registration as a licensed practical nurse 6(1) The requirements for initial registration as a licensed practical nurse are as follows: (a) the applicant must (i) have successfully completed a practical nursing education program in Manitoba, (ii) have successfully completed a program of nursing education outside Manitoba that the board considers to be substantially equivalent to a practical nursing education program offered in Manitoba at the time the applicant graduated, or (iii) hold current active practising registration as a licensed practical nurse in good standing in another Canadian province or territory; (b) the applicant must have passed the examination; (c) if the applicant's first language is not English or French, the applicant must be able to speak and write either English or French with reasonable fluency; (d) the applicant must not (i) suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs, or (ii) possess a record of conviction under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada) or any criminal or penal statute of a jurisdiction outside Canada, that makes it desirable in the public interest that he or she not practise practical nursing. 6(2) An applicant who has received nursing education outside Manitoba that does not fully meet the criteria set out in subclause (1)⁠(a)⁠(ii), or who cannot produce evidence of or information relating to his or her education satisfactory to the board, may nevertheless be permitted to register if he or she (a) has undergone an assessment of his or her prior learning as may be required by the board; (b) if required, has successfully completed a course of instruction set by the board; and (c) has satisfied all other requirements for registration. Application for initial registration 7(1) An applicant for initial registration as a licensed practical nurse must submit the following to the executive director: (a) a completed application form; (b) satisfactory proof of identity and legal name; (c) evidence that he or she meets the eligibility requirements set out in section 6; (d) a completed criminal record review authorization form; (e) the fee provided for in the by-laws. 7(2) An applicant must disclose the following information about himself or herself and his or her practice of practical nursing or of any other profession, whether in Manitoba or in another jurisdiction: (a) a finding by any professional regulatory body of professional misconduct, conduct unbecoming, incompetence, an incapacity or lack of fitness to practise, or any similar finding; (b) a current proceeding by a professional regulatory body in relation to professional misconduct, conduct unbecoming, incompetence, an incapacity or lack of fitness to practise, or any similar current proceeding; (c) a denial of registration by a professional regulatory body; (d) a conviction for an offence under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada) or any criminal or penal statute of a jurisdiction outside Canada; (e) a professional liability claim. 7(3) An applicant who received nursing education outside Manitoba must also submit to the executive director (a) written verification by the original jurisdiction in which he or she was registered, that the applicant was in good standing; (b) written verification by every other jurisdiction in which the applicant is, or has been, registered during the previous seven years, confirming that the applicant was in good standing; and (c) a signed consent permitting the executive director to contact current and previous employers for the purpose of verifying employment as a licensed practical nurse. Registration by endorsement 8(1) An applicant currently registered in another Canadian province or territory may be registered by endorsement if the executive director is satisfied that the applicant has met the requirements of sections 6 and 7. 8(2) A temporary permit issued by another Canadian jurisdiction is not equivalent to registration as a licensed practical nurse for the purposes of registration by endorsement under subsection (1). REGISTRATION AS A GRADUATE PRACTICAL NURSE Eligibility for registration as a graduate practical nurse 9(1) An applicant for registration as a graduate practical nurse may have his or her name entered on the register of graduate practical nurses if he or she (a) meets all of the requirements for registration as a licensed practical nurse in section 6, except for passing the examination, and has applied to write and is waiting to write the examination or has written the examination and is awaiting results; or (b) is currently registered as a licensed practical nurse in another Canadian province or territory and is waiting for verification of satisfactory compliance with requirements for registration by endorsement under section 8. 9(2) An applicant for registration as a graduate practical nurse must also submit the documentation referred to in section 7, and the fee provided for in the by-laws. When graduate practical nurse must write examination 10 A graduate practical nurse (a) must write the examination at the first scheduled writing following registration as a graduate practical nurse; and (b) may write the examination no more than three times while on the graduate practical nurse register. Duration of graduate practical nurse registration 11(1) Registration as a graduate practical nurse must be for a period of not more than four months but may be renewed, upon application, in accordance with section 19. 11(2) The registration of a graduate practical nurse expires 30 days after the college receives (a) the examination results, for a graduate practical nurse registered under clause 9(1)⁠(a) who passes the examination; or (b) verification of satisfactory compliance with Manitoba requirements for registration by endorsement for a graduate practical nurse registered under clause 9(1)⁠(b). REGISTRATION AS A STUDENT Eligibility for registration as a student 12(1) An applicant for registration as a student may have his or her name entered on the register of students if he or she is currently enrolled full-time or part-time in a practical nursing education program, a practical nursing completer program, or a practical nursing refresher program. Duration of student registration 12(2) Registration as a student shall be for a period of not longer than 15 months, and may be renewed, on application, in accordance with section 20. 12(3) When a student completes the program or ceases to be enrolled as a student in the program, his or her registration expires. TEMPORARY PRACTICE IN MANITOBA Temporary practice 13 A person may have his or her name entered on the register of temporary practising licensed practical nurses if he or she (a) provides evidence satisfactory to the executive director that he or she (i) is qualified to practise as a licensed practical nurse in another jurisdiction, (ii) holds current registration in that other jurisdiction, and (iii) has a level of competence equivalent to that required for registration under subsection 8(1) of the Act; (b) applies to the executive director stating the particular circumstance and the proposed length of time that he or she wishes to practise; (c) complies with any policy established by the board for temporary registration; and (d) pays the fee provided for in the by-laws. REGISTRATION AS AN ADVANCED LICENSED PRACTICAL NURSE Eligibility for registration as an advanced licensed practical nurse 14(1) An applicant for registration as an advanced licensed practical nurse may have his or her name added to the register of advanced licensed practical nurses if the applicant (a) is currently registered as a licensed practical nurse; and (b) has acquired advanced practical nursing knowledge and competency, in satisfaction of criteria established by the board, through an education program, course of studies, or other education or experience. Practice areas for advanced licensed practical nurses 14(2) An advanced licensed practical nurse who has received advanced training approved by the board may, in addition to the areas of practice of a licensed practical nurse, and within guidelines approved by the board, practise in one or more specialized areas including, but not limited to: (a) operating room; (b) dialysis; and (c) foot care. CONVERTING REGISTRATION Conversion from student to graduate practical nurse 15 A student is entitled to have his or her registration converted from the register of students to the register of graduate practical nurses when he or she (a) completes a program referred to in subsection 12(1); (b) provides any information the executive director may require, in the form and within the time set by the board; and (c) pays the fee provided for in the by-laws. Conversion from graduate practical nurse to practising 16 A graduate practical nurse registered under clause 9(1)⁠(a) is entitled to have his or her registration converted from the register of graduate practical nurses to the register of practising licensed practical nurses when he or she (a) passes the examination; (b) provides any information the executive director may require, in the form and within the time set by the board; and (c) pays the fee provided for in the by-laws. RENEWAL OF REGISTRATION Periodic renewal 17 Each member must periodically renew registration with the board at such time or times as required by the board. Renewal of practising or advanced registration 18(1) A practising licensed practical nurse or an advanced licensed practical nurse is entitled to have his or her registration renewed by (a) providing any information that the executive director may require in the form and within the time set by the board; (b) paying the fee provided for in the by-laws; and (c) providing evidence of continuing competency for renewal of registration in accordance with the requirements of section 26. 18(2) If an applicant for renewal does not meet the requirements of clause (1)⁠(c), the executive director may renew the registration subject to terms and conditions for up to 180 days. M.R. 16/2025 Renewal of graduate practical nurse registration 19 Clauses 18(1)⁠(a) and (b) apply, with the necessary changes, to the renewal of a registration of a graduate practical nurse. Renewal of student registration 20 A student is entitled to have his or her registration renewed by (a) paying the registration fee provided for in the by-laws; (b) providing any information the executive director requires in the form and within the time set by the board; and (c) providing evidence that the applicant remains enrolled in a practical nursing education program, a practical nursing completer program, or a practical nursing refresher program. Renewal subject to conditions 21 The renewal of a registration is subject to any restrictions or conditions existing on the certificate of registration immediately before its renewal, unless the restrictions or conditions are removed in accordance with policies established by the board. CANCELLATION FOR NON-PAYMENT OF FEES Cancellation for non-payment of fees 22(1) When a member is in default for not having paid his or her renewal fee before December 1 of the registration year to which the renewal relates, the executive director shall immediately send a letter by ordinary mail addressed to the member at his or her address on the records of the college notifying the member of his or her default. If the default is not remedied on or before December 15 of that year, the registration of that member shall be automatically cancelled. 22(2) When a person's registration is cancelled under subsection (1), the executive director shall so notify the person by registered mail addressed to the member at his or her address on the records of the college, and shall send a copy to the person's employer listed on the records of the college. REINSTATEMENT Reinstatement upon payment of fees 23 The executive director may reinstate the registration of a practising licensed practical nurse, graduate practical nurse, student, or advanced licensed practical nurse that was cancelled for non-payment of fees, upon payment of the fees provided for in the by-laws. Reinstatement after cancellation for other reason 24(1) An applicant for reinstatement whose registration was cancelled for a reason other than non-payment of fees must (a) provide any information the executive director requires, in the form and within the time set by the board; (b) if the application is for reinstatement on the register of practising licensed practical nurses or the register of advanced licensed practical nurses, provide evidence of continued competency in accordance with the requirements of section 27; (c) provide evidence that he or she has satisfactorily complied with all requirements of registration; and (d) pay the fee provided for in the by-laws. 24(2) If an applicant for reinstatement on the register of practising licensed practical nurses or the register of advanced licensed practical nurses does not meet the requirements of clause (1)⁠(b), the executive director may reinstate the applicant's registration subject to terms and conditions for up to 180 days. M.R. 16/2025 LIABILITY PROTECTION Liability protection 25 Every member shall obtain and maintain the minimum amount of liability protection that is prescribed by the board. CONTINUING COMPETENCE Continuing competence for renewal 26(1) Subject to subsection (2), to satisfy the requirement of continuing competence for renewal of registration on the register of practising licensed practical nurses or the register of advanced licensed practical nurses, a member must have (a) practised for a minimum of 1,000 hours in the four years immediately preceding the year for which renewal is sought; and (b) completed courses or challenge programs, approved by the board, in physical assessment, intramuscular injections, and urinary catheterization. Registration with conditions where courses or programs not completed (before 2004 registration year) 26(2) If, at any time before renewal for the registration year that begins December 1, 2003, a member meets the requirements of clause (1)⁠(a) but not the requirements of clause (1)⁠(b), he or she is on renewal eligible only to receive a certificate of registration with conditions that prohibit the member from conducting any procedure referred to in clause (1)⁠(b) until the member has completed the course or challenge program for that procedure. Courses or programs mandatory beginning in the 2004 registration year 26(3) Subject to subsections 18(2) and 24(2), as the case may be, a member who does not meet the requirements of clauses (1)⁠(a) and (b) is: (a) not eligible to renew his or her registration on either the register of practising licensed practical nurses or the register of advanced licensed practical nurses for the registration year that begins December 1, 2003 or for any subsequent registration year; and (b) prohibited from practising as a licensed practical nurse or as an advanced licensed practical nurse after November 30, 2003. M.R. 16/2025 Continuing competence for reinstatement 27 To satisfy the requirement for continuing competence for reinstatement on the register of practising licensed practical nurses or the register of advanced licensed practical nurses, a member must (a) meet the requirements of section 26; or (b) complete an assessment of prior learning and, if required by the board following the assessment, complete a course of instruction set by the board. REGULATION REVIEW Review of regulation 28 Not later than five years after the day this regulation comes into force, the board must (a) review the effectiveness of the operation of this regulation, and in so doing, must consult with such persons affected by the regulation as the board considers appropriate; and (b) if it considers it advisable, amend or repeal this regulation. REPEAL Repeal 29 The Licensed Practical Nurses Regulation , Manitoba Regulation 318/88 R, and the Practical Nursing Education Programs Regulation, Manitoba Regulation 65/86, are repealed. SCHEDULE A STANDARDS FOR A PRACTICAL NURSING EDUCATION PROGRAM STANDARD I The agency sponsoring a Practical Nursing Education Program (hereinafter referred to as the sponsoring agency) shall develop a comprehensive plan for the program that: 1.1 Reflects an examination of the society or community in which the program is located. 1.2 Identifies the current and future health needs of the society or community and the resources that are available to meet these needs. 1.3 Demonstrates that a program is needed in that particular setting. 1.4 Describes the characteristics of the population from which learners are to be selected. 1.5 Demonstrates that the purposes and objectives of the program are congruent with the purposes and objects of the sponsoring agency. 1.6 Demonstrates that the environment within which the program takes place is appropriate to the learning needs of the learner. 1.7 Demonstrates that the program is compatible with statutory and other regulations that have implications for the learners, the teachers, and the graduates of the program. 1.8 Demonstrates that in the development of the program there was consultation with the statutory body that governs practical nursing, with relevant educational authorities in the sponsoring agency and in the jurisdiction, and with employers and other groups and/or individuals whose support has significance for the program. 1.9 Identifies the physical, human and fiscal resources, and their limitations, if any, that have implications for the program. 1.10 Provides an organizational structure that does not compromise the division responsible for the program, in meeting its objectives. 1.11 Identifies mechanisms to be used for the program evaluation. STANDARD II The division of the sponsoring agency which is responsible for practical nursing education shall provide a statement of its beliefs about nursing and the role of practical nursing that: 2.1 Identifies the phenomena with which practical nursing is concerned and the interrelationships among these phenomena. 2.2 Explains the conceptual framework upon which the nursing program is based. 2.3 Identifies relationships between theory and practice in practical nursing. 2.4 Identifies practical nursing roles and functions. 2.5 Identifies the relationship of the practice of practical nursing to the practice of other health care professions. 2.6 Identifies settings in which practical nursing can be practised. STANDARD III The division of the sponsoring agency which is responsible for practical nursing education shall provide a curriculum outline for the program that: 3.1 Describes the philosophy and objectives of the program. 3.2 Demonstrates logical timing and sequencing of content and process. 3.3 States specific objectives of the program and the strategies, methods and materials that will be used to meet these objectives. 3.4 Describes relevant learning experiences for learners and identifies suitable facilities and resources for these experiences. 3.5 Describes the criteria and methods designed to assess the performance of learners, concurrently and terminally, in relation to the objectives of the program. 3.6 Describes the criteria and policies for progression in the program and graduation from the program. 3.7 Describes the cognitive, affective and psychomotor skills that graduates will be able to demonstrate. 3.8 Describes the situations in which, and the circumstances under which, the graduates will be prepared to practise. STANDARD IV The sponsoring agency shall provide an operation plan for the program that: 4.1 Describes the organizational structure of the sponsoring agency and the place of the program in that agency. 4.2 Specifies criteria and policies for selection and admission of learners, including those with advanced standing. 4.3 Specifies criteria and methods for selection and professional development of teachers and other personnel whose activities directly impact on the program. 4.4 Describes the organization and functions of the program personnel. 4.5 Describes the rights, privileges and responsibilities of the learner. 4.6 Describes strategies used for maintaining liaison with cooperating agencies and other key stake holders. STANDARD V The sponsoring agency shall provide a description of the process used to evaluate the teachers and the program, that: 5.1 Outlines the criteria and methods designed to assess the performance of the teachers in relation to the objectives of the program and policies of the sponsoring agency. 5.2 Provides a statement of the goals and objectives for an evaluation plan for the program. 5.3 Outlines the criteria and methods for formative and summative evaluation, designed to assess the effectiveness of the program.
