NOTICE TO ABATE A HEALTH HAZARD Notice to abate — inspector 2(1) If an inspector reasonably believes that a health hazard exists or might exist, but is not authorized to make a health hazard order, the inspector may prepare a notice to abate the health hazard and serve it on one or more persons described in section 25 of the Act. Service of notice 2(2) A notice of abatement may be served (a) personally; (b) by registered or certified mail sent to the last known address of the person or persons to whom the notice is directed; or (c) by placarding a place or premises to which the notice relates. Contents of notice 3 A notice to abate must (a) describe the health hazard that is to be abated; (b) specify the period of time within which the abatement is to be completed; and (c) specify, if the inspector considers it advisable, the manner in which the abatement is to be effected. Compliance with notice 4 A person to whom a notice is directed must comply with the notice. Notice to medical officer 5 An inspector who prepares and serves a notice to abate a health hazard under section 2 must give a copy of the notice to a medical officer as soon as practicable. REPORTING HEALTH HAZARDS Meaning of "health officer (food)" 6(1) In this section, "health officer (food)" means a health officer described in section 10 of the Public Health Personnel Regulation . Health hazard re food may be reported to a health officer (food) 6(2) For the purpose of subsection 40(1) of the Act, a person who believes that a health hazard exists in relation to (a) food; (b) a food handling establishment; or (c) the transportation of food; may report that belief, and the basis for it, to a health officer (food). REPEAL Repeal 7 The Insanitary Conditions Regulation , Manitoba Regulation 325/88 R, is repealed. COMING INTO FORCE Coming into force 8 This regulation comes into force on the same day that The Public Health Act , S.M. 2006, c. 14, comes into force.
