This regulation defines “Act,” sets a 100-hours-a-year lobbying threshold for certain organization insiders, lets the registrar require extra contact details in some returns, sets when electronic filings are deemed received, and states when the regulation comes into force.

L178 Regulation 34/2012 Registered March 26, 2012 bilingual version (HTML) Definition 1 In this regulation, "Act" means The Lobbyists Registration Act . Who is an in-house lobbyist 2(1) For the purpose of subsection 1(2) of the Act (lobbying must constitute significant part of duties), a significant part of the activities of an employee, partner or sole proprietor of an organization is at least 100 hours annually. 2(2) In determining whether lobbying amounts to at least 100 hours annually, all time spent on activities, including preparation, that are directly related to and necessary for carrying out lobbying must be included. Non-application of the Act 3 For the purpose of subsection 3(1) of the Act, the Act does not apply to the following persons when acting in their official capacity: (a) members of the Legislative Assembly and members of the Executive Council, and any individuals on their staff; (b) officers and employees of the Legislative Assembly, and any individuals on the staff of officers of the Assembly. Additional content of return 4 Whenever section 6 of the Act requires a return to include the business address of a consultant lobbyist, in-house lobbyist or other person or organization, the registrar may also require a business telephone number and business e-mail address to be included. Deemed receipt of returns 5 A return or other document filed electronically under section 8 of the Act is deemed to be received by the registrar as follows: (a) on the date the registrar actually receives the document, if it is received on a business day at or before 5:00 p.m. on that day; (b) on the first business day after the date the registrar actually receives the document, if it is received after 5:00 p.m. on a business day, or on a Saturday or holiday. Coming into force 6 This regulation comes into force on the day that Schedule A of The Lobbyists Registration Act and Amendments to The Elections Act, The Elections Finances Act, The Legislative Assembly Act and The Legislative Assembly Management Commission Act , S.M. 2008, c. 43 comes into force.
