Wild Rice Regulation
This regulation sets out wild rice permit and licence rules, including permit and licence definitions, designated harvesting areas, fee timing, expiry dates, and annual operating-certificate and reporting requirements for licence holders.
Wild Rice Regulation, M.R. 38/88 R The Wild Rice Act , C.C.S.M. c. W140 Regulation 38/88 R Registered January 18, 1988 bilingual version (HTML) 1 In this regulation, "block licence" means a production licence for an area or a part of an area described on a plan of survey prepared by the Director of Surveys of the Department of Natural Resources and Northern Development; (« licence de bloc ») "harvesting permit" means a permit for harvesting wild rice by mechanical means within an area or part of an area designated under section 5 of the Act; (« permis de récolte ») "mechanical harvesting permit" means a permit for harvesting wild rice by mechanical means for which provision is made in section 4 of the Act; (« permis de récolte mécanique ») "picker's permit" means a permit for harvesting wild rice by manual means within an area or part of an area designated under section 5 of the Act. (« permis de cueilleur ») 2 The forms set out in Schedules A to M are prescribed as the forms for licences, permits, load slips and applications under the Act. 3 For the purposes of section 5 of The Wild Rice Act , the areas of Crown land set out in Schedule N are designated as areas in which any person may without a licence engage in the manual or mechanical harvesting of wild rice if the person holds a permit and complies with the terms and conditions of the permit. M.R. 529/88 4 Every harvesting permit and every picker's permit expires on October 31st next following its date of issue. 5 Every buyer's permit and every mechanical harvesting permit expires on December 31st next following its date of issue. 6(1) The fees for licence applications and licences are as set out in Schedule O. 6(2) The fees for any licence application are payable at the time the application is submitted. 6(3) The fees for any licence are payable on or before July 1st next following the date of issue of the licence and on or before July 1st of each year thereafter during the period of validity of the licence. 7 The fees for permits are as set out in Schedule O and are payable at the time the application for any permit is submitted. 8 No holder of a licence shall commence harvest operations under the licence in any year unless and until he has applied for and obtained from the minister an operating certificate showing that, as at the date of the certificate, he has made all payments due under the licence and has complied with all other terms and conditions of the licence. 9 Every holder of a licence shall keep and maintain, and shall submit to the minister in each year along with the application for the operating certificate required under section 8 (a) a development plan showing the holder's future plans for seeding, propagation, structural improvements and future water control requirements; (b) a load slip book containing all load slips issued to the holder during the immediately preceding year; and (c) a production record showing the volume of all wild rice harvested under the licence in the immediately preceding year. The lands contained within the following boundary are constituted and established as a Wild Rice Zone, to be known as: "Natural Wild Rice Zone" – Nopiming Unit means the Crown land contained within the area starting at the Ontario boundary and the north boundary of the Whiteshell Provincial Park, west along this north boundary to the top of township 13, thence west along the township line to the range line between ranges 6 and 7 E.P.M., north to the shore of Lake Winnipeg, north along the east shore of Lake Winnipeg to the top of township 30, east to the range line between ranges 8 and 9, south to the top of township 29, east to the range line between 10 and 11, north to the top of township 30, east to range line between 11 and 12, north to the top of township 32, east to the range line between ranges 12 and 13, south to the top of township 30, east to the range line between ranges 14 and 15, south to the top of township 29, east to the range line between 15 and 16, south to the top of township 27, east to the range line between ranges 16 and 17, south to the top of township 26, east to the Ontario boundary, south along this boundary to the north boundary of the Whiteshell Provincial Park. Interlake Unit means the Crown land contained within the area starting on the east shore of Lake Manitoba at the top of township 21, east along this township line to Provincial Trunk Highway 68, along this highway to the Principal Meridian, north to the top of township 24, east to the west shore of Lake Winnipeg, north along this shore to the top of township 42, west to the range line between 17 and 18 W.P.M., south on this range line to Birch Island, south along the west shore of Birch Island to the top of township 38, west on this township line to the range line between 18 and 19, south on this range line to the top of township 35, east to the east shore of Lake Winnipegosis, south along this shore to the top of township 30, east to the west shore of Lake Manitoba, north along this shore and south to the top of township 21. 2. "Block Wild Rice Zone" – "Block Zone" means the Crown land contained within the area starting at the Ontario boundary at the top of township 26, west to the range line between ranges 16 and 17, north to the top of township 27, west to the range line between 15 and 16, north to the top of township 29, west to the range line between ranges 14 and 15, north to the top of township 30, west to the range line between ranges 12 and 13, north to the top of township 32, west of the range line between ranges 11 and 12, south to the top of township 30, west to the range line between ranges 10 and 11, south to the top of township 29, west to the range line between ranges 8 and 9, north to the top of township 30, west to the east shore of Lake Winnipeg, north along the east shore of Lake Winnipeg to the top of township 46, east to the range line between ranges 7 and 8, south to the top of township 42, east to the range line between ranges 11 and 12, south to the top of section 18 in township 42, range 12 E.P.M., east to the range line between ranges 14 and 15, north to the top of township 43, east to the Ontario boundary, south along this boundary to the top of township 26. 3. "Swan-Pelican Wild Rice Zone" – "Swan-Pelican zone" means the Crown land contained within the area starting on the top of township 34, on the range line between ranges 18 and 19 W.P.M., north along this range line to the top of township 38, east to Birch Island, north along the west shore of Birch Island to the range line between 17 and 18, north to the top of township 42, along this township line to the west shore of Lake Winnipegosis, north along this shore to the range line between ranges 24 and 25 W.P.M., south to the top of township 37, east to the range line between ranges 22 and 23 W.P.M., south to the top of township 34, east to the range line between 18 and 19 W.P.M. 4. "Manigotogan Wild Rice Zone" – Manigotogan River, between the west shore of Gem Lake and the east shore of Long Lake in Townships 21 and 22 Ranges 15 and 16 EPM; 5. "Moose River Wild Rice Zone" - Moose River between Provincial Road 314 and the north shore of Tooth Lake in Township 21 Range 15 EPM; 6. "Maskwa River - Little Bear Creek Wild Rice Zone " - That portion of the Maskwa River and Little Bear Creek lying within Township 18 Ranges 10 and 11 EPM. Production Licence will be based on Licence Fee of $25.00 plus production fee of 3¢ per pound of average declared production over previous three year period. Example: Licence Fee: C. Block Licence D.
