Named health authorities must submit French language services plans to the minister and follow ministerial requirements for approval, amendments, reporting, coordination, and public notice posting.

(« Plan ») M.R. 135/2013 ; 33/2022 Requirement for French Language Services Plan 2(1) The following health authorities must, at the time and in the form required by the minister, submit a proposed plan of French language services to the minister for approval: (a) Interlake-Eastern Regional Health Authority; (b) Prairie Mountain Health; (c) Southern Health–Santé Sud; (d) Winnipeg Regional Health Authority; (e) the provincial health authority; (f) the cancer authority. 2(2) In a proposed plan, the health authority shall (a) describe its policy respecting French language services; (a.1) list the bilingual and francophone facilities and programs that it operates; (b) describe the measures it will implement to ensure that health services are available and accessible in French; (c) describe the communication strategy it will use to publicize the availability and accessibility of its French language services; (d) describe how it will consult with and ensure the involvement of French-speaking communities and bilingual and francophone facilities and programs in (i) developing proposed amendments to the plan under section 4, and (ii) preparing reports to the minister under section 6; and (e) deal with any other matter and contain any other information that the minister requires. 2(3) In preparing a proposed plan, a health authority shall consult with (a) French-speaking communities; (b) health care providers, health corporations and health care organizations, including bilingual and francophone facilities and programs; (c) other health authorities; and (d) any other person the health authority considers appropriate. M.R. 135/2013 ; 33/2022 Approval of the minister 3(1) After receiving a proposed plan, the minister may provide it to any person the minister considers should review it and invite their comments. 3(2) If the proposed plan is satisfactory to the minister, the minister may approve it in the form in which it was submitted by the health authority. 3(3) If the proposed plan is not satisfactory to the minister, the minister may refer it back to the health authority to be revised in accordance with any directions the minister considers appropriate. 3(4) The health authority shall revise a proposed plan that is referred back to it in accordance with the minister's directions, and shall re-submit it to the minister for his or her approval at the time required by the minister. M.R. 33/2022 Amendments to a plan 4(1) A health authority shall submit any amendments it proposes to make to an approved plan to the minister for his or her approval. 4(2) In addition, the minister may require a health authority to make amendments to an approved plan about any matter the minister specifies, and the authority shall make the amendments and submit them to the minister for his or her approval. 4(3) Section 3 applies to amendments under this section. M.R. 33/2022 Appointment of coordinator 5 Except where the minister determines otherwise, a health authority shall appoint a bilingual employee to coordinate the development and implementation of the plan. M.R. 33/2022 Posting a notice 5.1 For each of the bilingual and francophone facilities and programs operated by a health authority, the authority must post a notice of the designation as a bilingual or francophone facility or program in accordance with guidelines approved by the minister. M.R. 135/2013 ; 33/2022 Report 6 A health authority shall submit a report to the minister on the operation of its plan at the times and in the form required by the minister. M.R. 33/2022 Coming into force 7(1) This regulation, except items 8 and 9 of the Schedule, comes into force on the day it is published in The Manitoba Gazette . 7(2) Items 8 and 9 of the Schedule come into force on April 1, 1998.
