This regulation sets rules for when agricultural products may be certified as organic, restricts packaging and labelling of products marketed as organic, and requires recordkeeping for producers, preparers, and retail sellers.
Organic Agricultural Products Regulation, M.R. 51/2013 The Organic Agricultural Products Act , C.C.S.M. c. O77 Regulation 51/2013 Registered April 25, 2013 bilingual version (HTML) Definitions and interpretation 1(1) The following definitions apply in this regulation. "Act" means The Organic Agricultural Products Act . («  Loi  ») "CAN/CGSB 32.310" means Canadian General Standards Board standard CAN/CGSB 32.310, Organic Production Systems — General Principles and Management Standards . (« norme CAN/CGSB 32.310 ») "CAN/CGSB 32.311" means Canadian General Standards Board standard CAN/CGSB 32.311, Organic Production Systems — Permitted Substances List . (« norme CAN/CGSB 32.311 ») " Organic Products Regulations, 2009 " means the Organic Products Regulations, 2009 , SOR/2009-176, made under the Canada Agricultural Products Act . («  Règlement sur les produits biologiques (2009 ) ») 1(2) In this regulation, a reference to CAN/CGSB 32.310 or to CAN/CGSB 32.311 is a reference to the most recent version of the standard. Certification of organic agricultural products 2 For the purpose of the Act, an agricultural product is certified as organic only if (a) a certification body that is authorized to make organic certifications in respect of the product under the Organic Products Regulations, 2009 , (i) determines, after verification in accordance with those regulations, that (A) in the case of a multi-ingredient product, at least 70% of its contents are organic and its composition complies with the requirements set out in CAN/CGSB 32.310, (B) the substances used in the production and processing of the agricultural product are those set out in, and used in the manner described in, CAN/CGSB 32.311, and (C) the production and processing methods used and the control mechanisms in place comply with the requirements set out in CAN/CGSB 32.310 and with the general principles respecting organic production set out in that standard, and (ii) certifies that the product is organic within the meaning of those regulations, and the certification is neither suspended nor cancelled for the purpose of those regulations; or (b) a certification body referred to in paragraph 27(1)⁠(b) or subsection 27(2) of the Organic Products Regulations, 2009 , certifies the product as organic as permitted by that paragraph or that subsection, and the certification is neither suspended nor cancelled for the purpose of those regulations. Packaging and labelling of organic agricultural products 3 A person must not package and label an agricultural product that is marketed using the term "organic" or "biologique" unless the packaging and labelling (a) is certified, within the meaning of subsection 15(1) of the Organic Products Regulations, 2009 , by a certification body that is authorized to make a packaging and labelling certification in respect of the product; or (b) if applicable, is certified in accordance with an agreement or arrangement referred to in paragraph 27(1)⁠(b) or subsection 27(2) of those regulations. Records to be kept by producers and preparers 4 A person who produces or prepares an agricultural product that is certified as organic for the purpose of section 2 of the Act must maintain records as required by section 17 of the Organic Products Regulations, 2009 , even though the agricultural product is marketed only within Manitoba. Records to be kept by retail sellers 5 A person who, in a retail sale, markets an agricultural product that is certified as organic for the purpose of section 2 of the Act (a) must maintain records about the person's acquisitions, sales, storage and handling of the product that meet the requirements of paragraphs 4.4, 4.4.1(a), 4.4.1(b), 4.4.2 and 4.4.3 of CAN/CGSB 32.310; and (b) must otherwise comply with those paragraphs; to the same extent as though the person was an operator within the meaning of those paragraphs. Coming into force 6 This regulation comes into force on the same day that The Organic Agricultural Products Act , S.M. 2007, c. 15, comes into force.
