(« conjoint ») M.R. 82/2000 ; 105/2003 ; 88/2007 PERSONAL CARE SERVICES Personal care services 2 Where provided in a personal care home, personal care services are the goods and services set out in Schedule A which are not excluded under the Excluded Services Regulation under the Act. M.R. 145/93 Entitlement to personal care 3 Where (a) an insured person meets the waiting period requirement set out in section 4; (b) the need of the insured person for personal care in a personal care home has been established to the satisfaction of an assessment panel; and (c) the insured person is admitted to a personal care home in accommodation consistent with his or her need; the insured person is entitled to receive personal care without paying any charge other than the authorized charges referred to in section 6. Waiting period 4(1) Except as provided in this section, a waiting period of 24 consecutive months must elapse after a person becomes a resident before he or she is entitled to personal care. 4(2) The waiting period requirement does not apply to a Canadian citizen, or to a permanent resident as defined in the Immigration Act (Canada), who (a) has been a resident of Manitoba for a total of 30 years; (b) leaves Canada and subsequently returns to Canada after an absence of less than 10 years; and (c) re-establishes himself or herself as a resident of Manitoba. 4(3) The waiting period requirement does not apply to a person who has been a resident of a province or territory of Canada for five consecutive years and immediately establishes himself or herself as a resident of Manitoba. 4(4) The minister may waive the waiting period requirement for a person who meets the criteria set out in clause 3(b) if the minister is satisfied that a waiver is desirable to avoid an inappropriate use of health care resources. When minister may cease to make payment 5 The minister may cease to pay for personal care when the assessment panel determines that the insured person no longer needs personal care in a personal care home. Basic authorized charges 6(1) Subject to section 6.1, a personal care home shall make an authorized charge to an insured person of $104.20 per day effective August 1, 2025. 6(2) In the case of an insured person who meets the established criteria for short-term respite care in a personal care home, the personal care home shall make an authorized charge of $43.10 per day effective August 1, 2025. M.R. 145/93; 154/93; 153/96; 131/97; 116/98; 89/99; 82/2000 ; 106/2001 ; 91/2002 ; 105/2003 ; 127/2004 ; 98/2005 ; 138/2006 ; 88/2007 ; 108/2008 ; 109/2009 ; 79/2010 ; 75/2012 ; 96/2013 ; 97/2015 ; 119/2016 ; 82/2017 ; 70/2018 ; 116/2019 ; 71/2020 ; 86/2022 ; 72/2024 ; 50/2025 Income-based reduction in authorized charges 6.1(1) When the net income of an insured person who is single, widowed, separated or divorced is an amount set out in Column 1 of Schedule B, the insured person is entitled to have the authorized charge under subsection 6(1) reduced to the amount set out opposite the person's net income in Column 3. 6.1(2) In the case of an insured person who is the spouse or common-law partner of another insured person who resides in a health facility, when the combined net income of the two spouses or common-law partners is divided by two and the resulting amount is an amount set out in Column 1 of Schedule B, each of them is entitled to have the authorized charge under subsection 6(1) reduced to the amount set out opposite the person's net income in Column 3. 6.1(3) When the combined net income of (a) an insured person; and (b) his or her spouse or common-law partner who resides outside of a health facility; is an amount set out in Column 2 of Schedule B, the insured person is entitled to have the authorized charge under subsection 6(1) reduced to the amount set out opposite that net income in Column 3. 6.1(3.1) If an insured person is required to pay service fees to the Public Trustee because the Public Trustee is the person's committee or substitute decision-maker for property, the amount of the reduction in the authorized charge under this section is to be adjusted as follows: 1. If the insured person's net income is between $21,961.07 and $45,561.98, that income is to be reduced by 5.66038% for the purpose of calculating the reduction under subsection (1) or (2). 2. If the insured person has a spouse or common-law partner who resides outside of a health facility and the spouses' or common-law partners' combined net income is between $66,853.07 and $89,157.98, that income is, for the purpose of calculating the reduction under subsection (3), to be reduced by an amount equal to 5.66038% of the combined net income minus $44,892. 6.1(4) An insured person entitled to a reduction under this section must apply for the reduction to the minister or, with the approval of the minister, to the personal care home or health facility in which he or she resides. 6.1(5) In this section, "net income" means an individual's net income for the taxation year that ended immediately before the beginning of the year in which an authorized charge is payable less the total combined federal and provincial tax payable by the individual for that taxation year, determined in accordance with the Income Tax Act (Canada); (« revenu net ») "year in which an authorized charge is payable" means the period from August 1 of one year to July 31 of the next year. (« année pendant laquelle les frais admissibles sont redevables ») M.R. 116/98; 57/2000 ; 82/2000 ; 106/2001 ; 91/2002 ; 105/2003 ; 127/2004 ; 98/2005 ; 138/2006 ; 88/2007 ; 108/2008 ; 109/2009 ; 79/2010 ; 75/2012 ; 96/2013 ; 97/2015 ; 119/2016 ; 82/2017 ; 70/2018 ; 116/2019 ; 71/2020 ; 86/2022 ; 72/2024 ; 50/2025 Review of authorized charges 6.2(1) If an insured person is unable to pay an authorized charge under subsection 6(1) because of extenuating circumstances, he or she may request the minister to review the amount of the authorized charge. 6.2(1.1) A request under subsection (1) must (a) be in writing and set out the reasons for the request; and (b) subject to subsection (1.2), be submitted to the minister within 30 days after the authorized charge, in the specific amount set out in subsection 6(1), was first charged to the insured person. 6.2(1.2) A request under subsection (1) which is not submitted within the period set out in clause (1.1)⁠(b) (a) may be accepted by the minister if (i) the request is submitted within one year after the authorized charge was first charged to the insured person, and (ii) the minister is satisfied that the insured person was unable to submit the request within the period set out in clause (1.1)⁠(b); and (b) must be accepted by the minister if the board, on further consideration by the board under subsection (1.3), approves the request to proceed to a review. 6.2(1.3) If the minister does not accept a request for a review under clause (1.2)⁠(a), the minister must refer the request to the board for further consideration, and give notice of the referral to the insured person. The board must then consider the request and advise the minister and the insured person as to whether or not it approves the request to proceed to a review. 6.2(2) On a review, the minister may, (a) confirm the authorized charge; or (b) reduce the authorized charge to an amount that is not less than $43.10 per day. M.R. 116/98; 89/99; 82/2000 ; 106/2001 ; 91/2002 ; 105/2003 ; 127/2004 ; 98/2005 ; 138/2006 ; 88/2007 ; 108/2008 ; 109/2009 ; 79/2010 ; 75/2012 ; 96/2013 ; 97/2015 ; 119/2016 ; 82/2017 ; 70/2018 ; 116/2019 ; 71/2020 ; 86/2022 ; 72/2024 ; 50/2025 Appeal of authorized charges 6.3(1) If an insured person is not satisfied with the outcome of a review under section 6.2, he or she may appeal the amount of the authorized charge calculated under sections 6 and 6.1 to the board. 6.3(2) On considering an appeal, the board may (a) confirm the original amount of the authorized charge; or (b) order the authorized charge to be reduced to an amount that is not less than $43.10 per day. M.R. 116/98; 89/99; 82/2000 ; 106/2001 ; 91/2002 ; 105/2003 ; 127/2004 ; 98/2005 ; 138/2006 ; 88/2007 ; 108/2008 ; 109/2009 ; 79/2010 ; 75/2012 ; 96/2013 ; 97/2015 ; 119/2016 ; 82/2017 ; 70/2018 ; 116/2019 ; 71/2020 ; 86/2022 ; 72/2024 ; 50/2025 Waiver — spouse or common-law partner living in the community 6.4(1) Notwithstanding any other provision of this regulation, the minister may waive payment of all or part of an authorized charge payable by an insured person under subsection 6(1) in order to ensure that the spouse or common-law partner of the insured person does not suffer undue financial hardship, but only if the following conditions are met: (a) the spouse or common-law partner must reside outside a health facility; (b) the combined net income of the insured person and his or her spouse or common-law partner must be less than $41,100 plus $8,500 for each dependant of the insured person residing outside a health facility; and (c) the insured person and his or her spouse or common-law partner must have attempted to obtain income from all sources for which they are eligible, including but not limited to income assistance, Old Age Security and the Guaranteed Income Supplement. 6.4(2) In this section, "dependant" means a child of an insured person who is (a) under 18 years of age; (b) over 18 years of age and mentally or physically incapacitated; or (c) over 18 years of age and attending a university, secondary school or other educational institution. M.R. 82/2000 ; 106/2001 ; 91/2002 ; 105/2003 ; 127/2004 ; 98/2005 ; 138/2006 ; 88/2007 ; 108/2008 ; 109/2009 ; 79/2010 ; 75/2012 ; 96/2013 ; 97/2015 ; 119/2016 ; 82/2017 ; 70/2018 ; 116/2019 ; 71/2020 ; 86/2022 ; 72/2024 ; 50/2025 Authorized charges for private and semi-private accommodation 7(1) Subject to the approval of the minister, the authorized charge that may be made by a personal care home to an insured person for semi-private or private accommodation is, (a) in respect of semi-private accommodation, up to $2.50 per day; and (b) in respect of private accommodation, up to $5 per day; unless the minister has approved higher charges. 7(2) Accommodation that is used as private accommodation in a personal care home shall not have more than one bed per room and accommodation that is used as semi-private accommodation shall not have more than two beds per room. 7(3) In the case of an emergency, no personal care home with available private or semi-private accommodation shall refuse to admit a person because there is no standard accommodation available. Authorized charges by government personal care home 8 A government personal care home that makes an authorized charge to an insured person under section 6 or subsection 7(1) shall collect the amount of the charge on behalf of the minister and deposit it in an account in a bank, trust company or credit union designated by the minister for that purpose. No charge for private and semi-private accommodation in certain cases 9 No personal care home shall refuse personal care or make a charge in excess of the standard rate for private or semi-private accommodation if the person receiving personal care has not requested private or semi-private accommodation and the assessment panel confirms that the person is (a) an emergency admission and no standard accommodation is available in that personal care home; (b) an isolation case; or (c) in such condition that he or she requires that type of accommodation. Minimum charges for person for whom minister not liable for payment 10 The charges that may be made by a personal care home to a person for whom the minister is not liable for payment are, (a) if the personal care home is not in a health region, the rates approved for that personal care home under section 58 of the Act; and (b) if the personal care home is in a health region, the rates approved by the minister for that personal care home under the Act. M.R. 78/97 Access to chart and records 11 Every personal care home shall, on request, give a medical practitioner designated by the minister free access to the personal care home chart and other records pertaining to any insured person. Restriction on beds 12 Not more than 10% of the beds in any personal care home designated by the minister may be used for persons who are not entitled to receive personal care under section 46 of the Act. PERSONAL CARE HOME ADMINISTRATION Information 13 Every personal care home shall forward to the minister, (a) within 96 hours after the admission of a person, a report in the form and containing the information that the minister may require; (b) within 96 hours after a person is discharged from or dies in a personal care home, a report of the discharge or death in the form and containing the information that the minister may require; and (c) in respect of each person in a personal care home, additional reports in a form and containing the information that may be required by the minister at the times required by the minister. Books and records 14(1) Every personal care home shall (a) keep and maintain such books and records as will comply with the established and recognized accounting procedures and practices for personal care homes; (b) keep and maintain any other books and records as may be specifically required in writing by the minister and, if the personal care home is in a health region, by the regional health authority; and (c) provide the minister or, if the personal care home is in a health region, the regional health authority with any other records and statements that the minister or regional health authority may from time to time require. 14(2) If a personal care home that is not in a health region fails to comply with subsection (1), the minister may withhold payment to the personal care home of any monies payable to that personal care home until the personal care home is in compliance. 14(3) If a personal care home in a health region fails to comply with subsection (1), the minister may withhold payment to the regional health authority of any monies payable by the minister to the regional health authority and, despite any agreement to the contrary, the regional health authority may withhold payment of monies payable by the authority to the personal care home until the personal care home is in compliance. M.R. 78/97; 116/98 15(1) to (3) [Repealed] M.R. 78/97 Budgets 15(4) The minister, in respect of capital debt incurred on or after July 1, 1958, shall not approve any part of capital debt that is greater than the lesser of (a) the cost approved by the minister for land acquisition, buildings constructed, fixed equipment installed and other equipment, less the sum of (i) any construction grant paid by the Government of Canada or the Government of Manitoba, (ii) the total cost of serviced land, and (iii) such funds in the capital fund account as the minister may determine; or (b) the actual amount borrowed for land acquisition, building construction, fixed equipment installed and other equipment. M.R. 78/97 Application for loan 16 In making application for approval of a loan a non-proprietary personal care home shall furnish such information and particulars as may be required by the minister. Equipment fund bank account 17(1) All monies received by a non-proprietary personal care home on account of that portion of non-proprietary personal care home costs approved under subsection 21(8) arising from depreciation on equipment, shall be deposited in a separate account in a bank, trust company or credit union of the non-proprietary personal care home, which shall be known as the "equipment fund bank account" and, subject to subsection (2), those monies shall be used only for payment of approved equipment purchases. 17(2) Monies in the equipment fund bank account which represent depreciation on equipment may only be used for the purchase of equipment unless otherwise approved by the minister. 17(3) Monies in the equipment fund bank account which are not immediately required may be invested by the non-proprietary personal care home from time to time in any registered stock, bonds, debentures or securities of or guaranteed by the Government of Canada, or of or guaranteed by the Government of Manitoba. Reserve fund bank account 18(1) All monies received by a non-proprietary personal care home on account of that portion of non-proprietary personal care home costs approved under subsection 21(8) arising from replacement reserves, shall be deposited in a separate account in a bank, trust company or credit union of the non-proprietary personal care home, which shall be known as the "reserve fund bank account" and, subject to subsection (2), those monies shall be expended only for payment of approved major repairs. 18(2) Monies in the reserve fund bank account which represent replacement reserve allowances may only be used for the purchase of major repair items unless otherwise approved by the minister. 18(3) Any monies in the reserve fund bank account which are not immediately required may be invested by the non-proprietary personal care home from time to time in any registered stock, bonds, debentures or securities of or guaranteed by the Government of Canada, or of or guaranteed by the Government of Manitoba. Bank accounts: transfer of operations to regional health authority 18.1 Notwithstanding sections 17 and 18, where the operations, property and obligations of one or more non-proprietary personal care homes are transferred to a regional health authority, the regional health authority (a) shall deposit in a separate account in a bank, trust company or credit union of the regional health authority, which shall be known as the "equipment fund bank account", monies so transferred to the regional health authority, which were in, or were to be deposited in, the equipment fund bank accounts maintained by the personal care home or homes under section 17; (b) shall deposit in a separate account in a bank, trust company or credit union of the regional health authority, which shall be known as the "reserve fund bank account", monies so transferred to the regional health authority, which were in, or were to be deposited in, the reserve fund bank account maintained by the non-proprietary personal care home or homes under section 18; (c) shall expend the monies from the equipment fund bank account and the reserve fund bank account under clauses (a) and (b) in accordance with the strategic and operational plan approved by the minister under The Health System Governance and Accountability Act ; and (d) may invest the monies from the equipment fund bank account and the reserve fund bank account under clauses (a) and (b) in any registered stocks, bonds, debentures or securities of, or guaranteed by the government of Canada or Manitoba and in accordance with The Health System Governance and Accountability Act and the regulations under that Act. M.R. 78/97; 72/2024 Separate accounts 19(1) Every non-proprietary personal care home shall (a) maintain in its records a separate account to be known as the "capital fund account" which shall include (i) the equipment fund bank account, and (ii) all investments made from the equipment fund bank account; and (b) at the end of each year, submit to the minister or, if the personal care home is in a health region, to the regional health authority, a statement and other particulars respecting its capital fund account, in the form that the minister or the regional health authority may require. 19(2) Every non-proprietary personal care home shall (a) maintain in its records a separate account to be known as the "reserve fund account" which shall include (i) the reserve fund bank account, (ii) all investments made from the reserve fund bank account; and (b) at the end of each year, submit to the minister or, if the personal care home is in a health region, to the regional health authority, a statement and other particulars respecting its reserve fund account, in the form that the minister or the regional health authority may require. 19(3) If the operations of one or more non-proprietary personal care homes are transferred to a regional health authority, the regional health authority shall (a) maintain in its records a separate account to be known as the "capital fund account", which shall include (i) the equipment fund bank account established by the regional health authority under section 18.1, and (ii) all investments made from the equipment fund bank account; (b) maintain in its records a separate account to be known as the "reserve fund account", which shall include (i) the reserve fund bank account established by the regional health authority under section 18.1, and (ii) all investments made from the reserve fund bank account; and (c) at the end of each year, submit to the minister a statement and other particulars in respect of the equipment fund account or the reserve fund account under clauses (a) and (b), in the form the minister may require. M.R. 78/97 Payments to personal care homes not in a health region 20(1) This section applies to personal care homes that are not in a health region. 20(1.1) The minister shall make to each non-proprietary personal care home a semi-monthly payment computed by dividing the amount of the non-proprietary personal care home's budget approved under section 58 of the Act, by 24. 20(2) In addition to the payments by the minister under subsection (1.1), a non-proprietary personal care home may retain 20% of all net income derived from the non-proprietary personal care home's charges to persons for private and semi-private accommodation that are in excess of the charges that would have been made to such persons had they been accommodated in a standard ward. 20(3) Subject to any adjustments that may be made under section 22, the minister shall make to each proprietary personal care home a semi-monthly payment computed by multiplying the applicable per diem rate by the number of days in a fiscal year multiplied by the number of residents for which the personal care home is licensed and for which the minister is responsible, at the monitored level of care, divided by 24. 20(4) The minister shall make installment payments to each government personal care home, in a manner and at such times as the minister and the government personal care home may agree, in an amount that does not exceed the amount of the budget of the personal care home approved under section 64 of the Act. M.R. 78/97 Payments for personal care homes in a health region 20.1(1) A non-proprietary personal care home or government personal care home in a health region shall be funded in accordance with any agreements between the operator of the personal care home and the regional health authority. 20.1(2) In addition to payments made by the minister under the Act, a regional health authority that operates a personal care home in a health region may retain 20% of all net income derived from the personal care homes charges to persons for private and semi-private accommodation that are in excess of the charges that would have been made to such persons had they been accommodated in a standard ward. M.R. 78/97 Year-end settlements 21(1) On or before October 1 in each year, every non-proprietary personal care home shall submit to the minister an audited financial statement and a statistical report which shall be in the form and contain the information that the minister may require respecting the operations of the personal care home for the 12-month period preceding March 31. 21(2) On or before October 1 in each year, every proprietary personal care home shall submit to the minister an audited financial statement and a statistical report which shall be in the form and contain the information as the minister may require respecting the operations of the personal care home for the 12-month period preceding March 31. 21(3) The audited financial statements of non-proprietary personal care homes may include depreciation on furniture and equipment, but for any item of equipment acquired at a cost over $4,000 depreciation may be included only if the minister has in writing approved the acquisition. 21(4) A budget officer shall examine the financial statement and recommend to the minister the total amount that the non-proprietary personal care home is entitled to receive for personal care received in the home by persons during that year, but before sending his or her recommendation to the minister, the budget officer shall notify the non-proprietary personal care home of his or her recommendation and give the non-proprietary personal care home an opportunity to request changes and to have the changes considered. 21(5) Where (a) the non-proprietary personal care home does not request changes; or (b) after considering the changes requested, the budget officer makes a decision respecting the changes; the budget officer shall forward a recommendation to the minister and, at the same time, notify the non-proprietary personal care home to that effect. 21(6) A non-proprietary personal care home that is dissatisfied with the recommendation of the budget officer may, within 30 days after receiving the notice under subsection (5), request the minister to refer the matter to the board. 21(7) If a non-proprietary personal care home requests a referral under subsection (6), the minister shall refer the matter to the board and the board shall hear the matter and make a recommendation to the minister, but the minister is not bound by the board's recommendation. 21(8) On the expiration of the time for a non-proprietary personal care home to request a referral to the board under subsection (6) or, if a referral has been made, on a recommendation being made by the board under subsection (7), the minister shall approve an amount respecting payment to the personal care home. 21(9) The amount approved under subsection (8) is the amount determined by the minister for the purpose of subsection 60(2) of the Act. 21(10) At the request of the minister in each year, every government personal care home shall submit a final statement of income and expenditures, with related statistics, which shall be in a form and contain the information the minister may require respecting the operation of the personal care home for the 12-month period preceding March 31 of that year. Adjustments 22(1) In this section, "actual annual resident occupancy" means the number of days in a fiscal year in which licensed beds in a personal care home are actually occupied by residents; (« taux annuel réel d'occupation ») "maximum annual resident occupancy" means the number of days arrived at by multiplying the number of days in a fiscal year by the number of residents for which a personal care home is licensed. (« taux annuel maximal d'occupation ») 22(2) A budget officer shall examine the payments made to each proprietary personal care home in each fiscal year and (a) where the actual annual resident occupancy exceeds the maximum annual resident occupancy by 1% or more, the minister shall pay the amount of the difference to the proprietary personal care home in question; (b) where the actual annual resident occupancy is less than the maximum annual resident occupancy by 1% or more, the minister shall recover the difference from the proprietary personal care home in question; and (c) where the difference between the actual annual resident occupancy and the maximum annual resident occupancy is less than 1%, no adjustment shall be made and no amount shall be either recovered, or paid out, in that regard. Resident trust accounts 23(1) In this section, "legal representative" means a committee appointed by a court, or a person holding a power of attorney executed by a resident, or the public trustee; (« représentant personnel ») "resident" means a person who resides in a personal care home. (« résident ») 23(2) If a personal care home administers resident trust funds, and if the resident or his or her legal representative requests such a service, the personal care home shall (a) have the resident or his or her legal representative sign an agreement recognizing the policy of the personal care home with respect to resident trust funds; (b) establish a general resident trust account into which shall be deposited all monies entrusted to the personal care home by residents or their legal representatives; (c) maintain a separate record of each resident's funds within the general resident trust account showing all deposits and withdrawals, and the date of each deposit and withdrawal; (d) if at the end of any calendar quarter, the resident has more than the sum of $400 in the general resident trust account, cause the excess funds to be transferred to a separate interest earning savings account established in the name of the individual resident at a bank, trust company or credit union as designated by the personal care home; (e) make all or part of the funds a resident has in the general resident trust account available to that resident or his or her legal representative upon the resident or his or her legal representative providing the personal care home with a written receipt; (f) use interest earned on the general resident trust account for the benefit of the residents as a whole, and maintain a record of all expenditures; (g) provide a resident or his or her legal representative with a written receipt or statement for all monies received by the personal care home for deposit in the general resident trust account; (h) maintain in proper order for a period of at least seven years after a resident leaves the personal care home, all documentation pertaining to the general resident trust account, including records of withdrawals and deposits, and copies of all receipts; (i) on the written request of the resident or his or her legal representative, provide a statement of his or her account; and (j) include the general resident trust account in the year-end audit of the personal care home. 23(3) The minister may at any time request an audit of the general resident trust account. Coming into force 24 This regulation comes into force on March 31, 1993. SCHEDULE A PERSONAL CARE SERVICES The following goods and services are personal care services: 1. Accommodation at the standard ward level. 2. Meals, including special and therapeutic diets. 3. Necessary nursing services. 4. Routine medical and surgical supplies. 5. Prescribed drugs, biologicals and related preparations approved by the minister. 6. Physiotherapy and occupational therapy in institutions approved by the minister for such services. 7.
