This regulation sets criteria the board must consider when deciding on financial assistance, defines “Act” and “Northern Manitoba,” adds extra conditions for fishing-industry enterprises, and repeals an older regulation.
Criteria for Financial Assistance Regulation, M.R. 60/2000 The Communities Economic Development Fund Act , C.C.S.M. c. C155 Regulation 60/2000 Registered May 15, 2000 bilingual version (HTML) Definition 1 In this regulation, "Act" means The Communities Economic Development Fund Act . Meaning of "Northern Manitoba" 2 For the purpose of clause 3(1)⁠(a) (object of fund) of the Act, "Northern Manitoba" means all that part of Manitoba north of the southern boundary of township 21. Criteria for determining financial assistance 3 In determining whether to provide financial assistance for an economic enterprise, the board shall consider the criteria set out in the Act, including those in sections 3, 7, 8, 11, 12 and 15, and the following: (a) the feasibility of the applicant's plan for the establishment or development of the enterprise; (b) the applicant's background, including credit history and relationship with granters of credit, particularly in relation to the enterprise; (c) the education and experience of the principal persons involved in the enterprise; (d) the availability of the technical and financial expertise required to successfully operate the enterprise; (e) any activity that could be generated or increased in businesses or other undertakings in the province by the enterprise; (f) the effect of the enterprise on the province and on the community in which it is located, including its effect on employment and other businesses or undertakings; (g) having regard to subsection 9(2) (encouragement of assistance from other institutions) of the Act, any financial assistance received or available from a financial institution, including the terms or conditions to which the assistance is subject, and their effect on the enterprise; (h) the nature and value of any security used or available in respect of financial assistance for the enterprise; (i) the availability of the product that is produced by the enterprise, and the market for the product; (j) the availability of services, including utilities and communication and transportation facilities, required to operate the enterprise; (k) any other criteria the board considers relevant to the application or enterprise. Additional criteria re enterprise in fishing industry 4 For the purpose of clause 3(1)⁠(b) (fishing industry) of the Act, financial assistance may be provided for an economic enterprise in the fishing industry only if the enterprise derives its main source of income from either of the following: (a) harvesting fish within the province by a fisherman, as defined under The Fisheries Act , who holds a licence under Part II.1 (licensing) of that Act; (b) growing, processing or selling fish, or products related to fish that are harvested or grown in the province. Repeal 5 The Criteria for Financial Assistance Regulation , Manitoba Regulation 202/94, is repealed.
