"Act" means The Emergency 911 Public Safety Answering Point Act . («  Loi  ») "PSAP" means public safety answering point. (« CRCU ») STANDARDS AND REQUIREMENTS FOR LICENCE APPLICANTS AND PSAP SERVICES Standards and requirements 2 Every applicant for a PSAP service licence and every holder of a PSAP service licence must (a) meet the standards and requirements set out in this regulation; and (b) ensure that its PSAP facility and its officers, employees and volunteers meet the standards and requirements set out in this regulation. RISK ASSESSMENT OF LOCATION Risk assessment re location of PSAP 3(1) A person, organization or PSAP service wishing to establish a PSAP facility at a location must carry out a risk assessment of the location. The risk assessment must be carried out in accordance with guidelines approved by the minister. 3(2) The person, organization or PSAP service must submit the results of the risk assessment to the minister before establishing the PSAP facility. If the person or organization does not have a PSAP service licence for the public safety answering point, the results must be submitted as part of the licence application. 3(3) The person, organization or PSAP service must not establish the PSAP facility until (a) the minister has reviewed the results of the risk assessment and approved the establishment of the PSAP facility; and (b) when a licence is required, the minister has issued the licence. 3(4) The minister may approve the establishment of the PSAP facility if he or she is satisfied with the results of the risk assessment or may refuse to approve it if he or she is not satisfied. 3(5) An approval may be subject to any terms and conditions that the minister considers appropriate. 3(6) If the person or organization is unlicensed and the minister is not satisfied with the results of the risk assessment, he or she may refuse to issue a licence until the PSAP service provides satisfactory results. EMERGENCY PLAN Emergency plan required 4(1) A PSAP service must prepare and adopt an emergency plan for preparing for, responding to and recovering from emergencies and disasters, as defined in The Emergency Measures Act , and must submit it to the minister for approval. 4(2) If the PSAP service is requesting approval to establish a PSAP facility or applying for a PSAP service licence, the PSAP service must submit the emergency plan when it submits the request or application to the minister. Section 3 applies in respect of the emergency plan in the same manner as it applies to a risk assessment. 4(3) In any case not mentioned in subsection (2), the PSAP service must submit the emergency plan within 90 days after the day this regulation comes into force. 4(4) The minister may approve an emergency plan with or without conditions, or may refer it back to the PSAP service for further action, with any recommendations or directions the minister considers appropriate. 4(5) When a plan is referred back to a PSAP service for further action, it must take that action in accordance with the minister's directions and resubmit it to the minister for approval. 4(6) After the minister approves a PSAP's emergency plan, the PSAP service must submit the plan to the Executive Co-ordinator of the Emergency Measures Organization for co-ordination with other emergency plans under The Emergency Measures Act . 4(7) When a PSAP service proposes to change its emergency plan, subsections (2) to (6) apply, with necessary modifications, to the proposed change. 4(8) A PSAP service must review and revise its emergency plan from time to time, as required by the minister, to ensure that the plan continues to be effective. PHYSICAL AND STRUCTURAL STANDARDS AND REQUIREMENTS Compliance with Codes 5 The PSAP facility and all its fixtures and equipment must comply in all respects with the Manitoba Building Code , Manitoba Electrical Code and Manitoba Fire Code . Lower windows must be bullet-resisting 6(1) Except as otherwise approved by the minister under section 3, all exterior windows that are in line-of-sight of another building or structure must meet the requirements for a Level 4 bullet-resisting equipment safety rating as defined and specified in UL 752, Standard for Bullet-Resisting Equipment , as amended from time to time. 6(2) Subsection (1) does not apply to any windows of a building in which a PSAP facility has been established that are attached to rooms or areas not used to operate the facility. M.R. 61/2021 Restriction on location of main utilities 7 Main utilities must not pass through those areas of a PSAP where equipment essential to the operation of the PSAP is installed. Protection of electrical services 8 All electrical conductors entering the PSAP facility must meet or exceed applicable CSA or ULC standards or codes and must include protection with devices, all properly grounded, and installed and operated according to manufacturer's standard, starting from the exterior, as follows: (a) lightning arrester; (b) heat coils; (c) current surge protector. Emergency lighting 9 The PSAP facility must be equipped with an emergency lighting system that (a) is powered by rechargeable batteries; (b) automatically maintains the batteries' charge at a sufficient level for the proper operation of the system; (c) operates automatically and immediately in the event of an interruption of normal electric power; (d) provides sufficient illumination for the safe and effective continuation of PSAP operations; and (e) has at least one unit of lamps in each of the PSAP operations area and any area of the PSAP facility where equipment required by this regulation, or necessary to the operation of the PSAP facility, is located. Automatic alarm systems 10(1) The PSAP facility must be equipped with (a) an automatic fire alarm system that (i) features annunciation by flashing light, and (ii) is designed to automatically transmit alarms to the fire department by way of a central alarm monitoring centre, as described in Article 3.2.4.7. of the Manitoba Building Code ; and (b) an operator-activated emergency assistance alarm system that annunciates internally and externally of the PSAP facility. 10(2) Audible and visual warning and evacuation signals from the alarm systems must not interfere with PSAP operations. Alternate power supplies 11(1) The PSAP facility must be equipped with a dedicated emergency generator and uninterruptible power supply. 11(2) The emergency generator must be capable of supplying sufficient power for the regular operation of all of the PSAP facility's functions, including the fire and emergency assistance alarm systems. 11(3) The emergency generator must be installed in compliance with CSA C282, Emergency Electrical Power Supply for Buildings , as amended from time to time, in an adequately ventilated area that has a fire resistance-rating of at least two hours. 11(4) The PSAP facility must have an on-site supply of generator fuel sufficient for the generator to operate at full capacity for 12 continuous hours. The PSAP service must have an arrangement satisfactory to the minister for a guaranteed supply of generator fuel. 11(5) The PSAP facility must have a separate storage battery, complete with automatic transfer switch. 11(6) The generator system must be operated monthly under normal operating load for at least two continuous hours. 11(7) The uninterruptible power supply must be cleaned and inspected every 12 months. 11(8) For at least seven years after any logged item, the PSAP service must keep a written log (a) showing the dates and times of generator maintenance and operation, and recording any failures of the generator system to operate as required; and (b) showing the dates and times of uninterruptible power supply maintenance, testing and operation, and recording any failures of the uninterruptible power supply to pass any test performed or operate as required. M.R. 61/2021 Restricted access policy and implementation 12(1) A PSAP service must establish, maintain and implement a policy, acceptable to the minister, restricting non-emergency access to the PSAP facility (a) to authorized PSAP service officers, employees and volunteers; (b) to other persons authorized by the PSAP service; and (c) to persons authorized by the minister to inspect PSAP facilities or audit PSAP operations. 12(2) The access policy must include the requirements that (a) all persons entering or leaving the PSAP facility, other than in an emergency, must (i) sign in or out on an entry and departure log sheet in a form acceptable to the minister and containing the information that he or she requires, or (ii) must have their names and time and date of entry or departure recorded using another system or method acceptable to the minister; and (b) the log sheets or other entry and departure records (i) be securely retained by the PSAP service in a manner, and for a period, acceptable to the minister, and (ii) be available for inspection at the request of a person authorized by the minister. EQUIPMENT STANDARDS AND REQUIREMENTS 911 communication system 13(1) A PSAP facility must be equipped with a 911 communication system that complies with the policies and guidelines issued to telecommunication service providers for such systems by the Canadian Radio-television and Telecommunications Commission, as amended from time to time. 13(2) The system must retain recordings of any 911 communications logged by the system for a minimum of two years. 13(3) The system must provide redundancy by using a minimum of two geographically diverse routes of communication. M.R. 61/2021 REQUIREMENT FOR ALTERNATE FACILITY Alternate location 14(1) Every PSAP service must have an alternate PSAP facility that (a) is approved under section 3; and (b) meets the following requirements: (i) it can become fully operational as a PSAP facility within six hours after a disruption to the primary PSAP facility, (ii) it maintains minimal PSAP functionality at all other times at a level acceptable to the Executive Co-ordinator of the Emergency Measures Organization. 14(2) The PSAP service must test all equipment and other functions at the alternate PSAP facility two times a year and maintain records of those tests to the same extent and in the same manner as equipment and functional tests done at the primary PSAP facility. M.R. 61/2021 OPERATIONAL STANDARDS AND REQUIREMENTS Operational requirements 15 Every PSAP facility must (a) receive emergency communications initiated by dialling "911" on a telephone and by any other means supported by the facility's 911 communication system; (b) determine the nature of the incident or emergency, the emergency services required and record the relevant data about the incident or emergency, and its response; (c) transfer any emergency communication received by the facility to the appropriate emergency service provider and notify or dispatch other emergency service providers as required; and (d) provide continuous service 24 hours per day and seven days per week. M.R. 61/2021 Recordkeeping 16 Every PSAP service must log all incoming and outgoing emergency communications on the PSAP facility's 911 communication system and include the following information: (a) if the communication is incoming, (i) any data available from the telecommunications network, (ii) the date and time of the communication, and (iii) the action taken by the PSAP service in response to the communication; (b) if the communication is outgoing or is transferred to another PSAP facility or an emergency service provider, (i) the name or identity, the address and the phone number, if any, of the recipient, and (ii) the date and time of the communication. M.R. 61/2021 Personal health information 17 Every PSAP service must comply with The Personal Health Information Act in its handling of personal health information about any person. STAFFING REQUIREMENTS Minimum staff requirements 18 A PSAP service must have at least two qualified operators monitoring the PSAP facility's 911 communications system at all times. M.R. 61/2021 Training and instruction 19(1) PSAP operators must be trained and certified according to the standards approved by the minister. 19(2) Without limiting the generality of subsection (1), every PSAP operator must be instructed in receiving and handling emergency communications. M.R. 61/2021 20 [Repealed] M.R. 61/2021 GENERAL REQUIREMENTS Emergency service providers 21 A PSAP must provide service only where an emergency service provider, or the agency or local authority to which the emergency service provider is responsible, agrees to a contract or arrangement with the PSAP service (a) that identifies when the PSAP facility is to transfer emergency communications to the emergency service provider; (b) that identifies whether the PSAP facility is to provide direct dispatch of emergency service providers, and if so, when it is to do so; (c) that defines the process for evaluating the PSAP facility's service delivery; and (d) that identifies arrangements about secondary dispatch services. M.R. 61/2021 Inspections 22(1) Subject to subsection (2), a PSAP service must allow the PSAP facility to be inspected at regular intervals, by a person authorized by the minister, to determine whether the PSAP service and the PSAP are complying with the Act and this regulation. 22(2) A person authorized by the minister for the purposes of this section must obtain security clearance from the PSAP service. A PSAP service must not unreasonably withhold giving security clearance to an authorized person. 22(3) The minister may determine the frequency of inspections. 22(4) The PSAP service must give the person doing the inspection full access to the PSAP facility and all records about the operation of the PSAP facility. Term of licence and licence fee 23 A PSAP service licence is valid for five years from the effective date stated in the licence, and the fee for the licence is $500. Transitional provision 24 For the purposes of section 13 of the Act, the effective dates of the deemed licences of The City of Winnipeg and The City of Brandon are the day on which this regulation comes into force, and those licences are valid for five years from that day. Coming into force 25 This regulation comes into force on the day The Emergency 911 Public Safety Answering Point Act , S.M. 1997, c. 19, comes into force.
