Solid Waste Area Management Project Establishment Regulation, M.R. 60/98 The Regional Waste Management Authorities Act , C.C.S.M. c. R38 Regulation 60/98 Registered April 9, 1998 bilingual version (HTML) S.W.A.M.P. Established 1 The Solid Waste Area Management Project (S.W.A.M.P) is established. Members 2 The members of S.W.A.M.P. shall be (a) the Rural Municipality of Stanley; (b) the Town of Winkler; and (c) the Town of Morden. Appointments to board 3(1) The board of S.W.A.M.P. shall be comprised of seven members appointed as follows: (a) three persons appointed by the Rural Municipality of Stanley, of which (i) two shall be members of its council, and (ii) one shall be one of its resident ratepayers; (b) two persons appointed by the Town of Winkler, both of whom shall be members of its council; (c) two persons appointed by the Town of Morden, both of whom shall be members of its council. 3(2) Subject to subsection(3), all board members shall be appointed for a two year term. 3(3) Three of the initial seven members of the board shall be appointed for a one year term only, and these three board members shall be chosen by each of the members of S.W.A.M.P. designating one of its appointees to a one year term. Waste site 4 S.W.A.M.P. shall operate a waste site on the land described as NW 1/4 36-3-4 WPM in Certificate of Title A67215. Service area 5 S.W.A.M.P. shall service the entire area of each member municipality, and any other area designated by its board. Fees 6 At the end of each calendar year, the Board shall set a fee schedule for the following year for each classification of waste. Deficit 7(1) At the end of the calendar year, S.W.A.M.P. shall review its revenues and expenses to determine if it has earned a profit or created a deficit. 7(2) In the event of a deficit, each member shall make a deficit reduction payment in an amount assessed by S.W.A.M.P. 7(3) In the event of a deficit, S.W.A.M.P. shall, by March 1 of the following year, (a) calculate, on a pro-rata basis according to waste volume processed by S.W.A.M.P., the amount of each member's required deficit reduction payment; and (b) notify each member of the amount of deficit reduction payment that it is required to pay to S.W.A.M.P. 7(4) Each member shall make its deficit reduction payment by April 30 of the same year that it receives notification under clause (3)⁠(b). 7(5) S.W.A.M.P. may impose a penalty on a member for an overdue deficit reduction payment, which penalty shall not exceed 1.25% per month.
