This regulation sets transitional rules for advisory council membership, consultation, and collaboration, and it makes limited Act sections inapplicable in specified transition cases.

R117 Regulation 61/2011 Registered May 30, 2011 bilingual version (HTML) Interpretation 1(1) In this regulation, "Act" means The Regulated Health Professions Act . 1(2) Terms used in this regulation have the same meaning as in subsection 223(1) of the Act. Transitional re Advisory Council 2 The following applies during the period of transition from regulating health professions under profession-specific Acts to regulating them under the Act: (a) a person must not be appointed as a member of the advisory council if he or she is a member of a college or association; (b) the advisory council's duties under subsection 148(1) of the Act include giving advice about continuing competency programs established under a profession-specific Act; (c) the advisory council must not consider or become involved in any other way in any matter respecting a specific person who is applying for membership or reinstatement in a college or association, or who is authorized to practise a health profession under a profession-specific Act; (d) the advisory council's obligation to consult under subsection 151(1) of the Act applies to colleges and associations; (e) at the request of the minister or the advisory council, a college or association must work with the advisory council as set out in subsection 151(2) of the Act. Transitional — persons working under delegation and supervision 2.1(1) Section 5 of the Act does not apply to a health care provider who is delegated the performance of a reserved act by a person who meets the requirements of subsection 224(2) of the Act. 2.1(2) Section 5 of the Act does not apply to a health care provider whose performance of a reserved act is supervised by a person who meets the requirements of subsection 224(2) of the Act. M.R. 190/2013 Transitional — pharmacy 2.2 Sections 58 to 74 of the Act do not apply to the establishment or operation of a licensed pharmacy under The Pharmaceutical Act . M.R. 190/2013 Coming into force 3 This regulation comes into force on the same day that Part 10 of The Regulated Health Professions Act , S.M. 2009, c. 15, comes into force.
