"Act" means The Regulated Health Professions Act . («  Loi  ») "college" means the College of Registered Psychiatric Nurses of Manitoba. (« Ordre ») "competent" , in relation to the performance of a reserved act, means that a member has the requisite skill, knowledge and judgment to perform that act. (« compétent ») "council" means the council of the college. (Version anglaise seulement) "former Act" means The Registered Psychiatric Nurses Act . (« loi antérieure ») "member" means a member of the college. (« membre ») "Schedule" means the Schedule to this regulation. (« annexe ») 1(2) A reference to a reserved act in this regulation is a reference to the reserved act listed in section 4 of the Act. Designation 2 Registered psychiatric nursing is designated as a regulated health profession for the purposes of the Act. Scope of practice 3 The practice of registered psychiatric nursing is the application of psychiatric nursing knowledge, skill and judgment, with a focus on mental health, addictions and neurodevelopmental disorders (a) to assist individuals, families, groups, and communities and populations to achieve, maintain and restore their optimal physical, mental, emotional, social and spiritual health; (b) to assess, diagnose, plan and provide treatment and interventions, to evaluate their effectiveness and to make referrals; (c) to teach clients and advocate with or on their behalf to enhance health and well-being; (d) to provide counselling to clients; (e) to coordinate, supervise, monitor, deliver and evaluate the provision of health care and psycho-social services; (f) to manage, administer and develop systems related to registered psychiatric nursing and the provision of health care and psycho-social services; (g) to teach nursing theory and the practice of registered psychiatric nursing; and (h) to engage in research related to health and the practice of registered psychiatric nursing. College 4 The College of Registered Psychiatric Nurses of Manitoba, continued under the former Act, is continued under clause 8(b) of the Act as the College of Registered Psychiatric Nurses of Manitoba for the regulated health profession of registered psychiatric nursing. Practice of registered psychiatric nursing 5 Subject to the Act and the regulations and any conditions on the member's registration or certificate of practice, a member may engage in the practice of registered psychiatric nursing. But in doing so, the member may not act beyond the scope of practice of registered psychiatric nursing. Reserved acts 6(1) In the course of engaging in the practice of registered psychiatric nursing, a member is authorized, subject to the regulations made by the council and any conditions on the member's registration or certificate of practice, to perform the applicable reserved acts set out in the Schedule. 6(2) Despite subsection (1), a member may only perform a reserved act that the member is competent to perform and that is safe and appropriate for the procedure being performed. TRANSITION Council 7(1) On the day this regulation comes into force, the board of the college established under the former Act is deemed to be the council established under section 13 of the Act. 7(2) The council's ability to act under subsection 12(2) of The Regulated Health Professions Act is not affected or impaired while the composition of the council changes from the composition under the former Act to the composition as set out under subsection 180(1) of The Regulated Health Professions Act even if a greater number of council members than is permitted under section 13 of that Act will be elected in 2022. Members of the council 8 On the day this regulation comes into force, a member of the board of the college established under the former Act is deemed to be a member of the council that is deemed to be established under section 13 of the Act. Officers 9 On the day this regulation comes into force, an officer of the college established under the former Act is deemed to be an officer of the college until the member's term of office expires or the appointment is revoked. Registrar 10 On the day this regulation comes into force, the executive director appointed by the board under the former Act is deemed to be appointed the registrar under section 23 of the Act. Committees 11(1) On the day this regulation comes into force, the investigation committee established under the former Act is deemed to be the complaints investigation committee established under section 22 of the Act. 11(2) On the day this regulation comes into force, the discipline committee established under the former Act is deemed to be the inquiry committee appointed under section 22 of the Act. 11(3) On the day this regulation comes into force, each member of a committee appointed under the former Act is deemed to be appointed a member of the successor committee under the Act for a term that is equal to the unexpired portion of the member's term under the former Act. By-laws and code of ethics 12 The college's by-laws and code of ethics made under the former Act that are in force on the coming into force of this regulation are deemed to be the college's by-laws and code of ethics made under the Act until they are amended or repealed under the Act. Application for registration not concluded 13 An application for registration made under the former Act but not concluded before the coming into force of this regulation must be dealt with under the former Act. Deemed registration 14 An individual whose name is on a register under the former Act on the day before the coming into force of this regulation is deemed to be registered in the appropriate membership class under the Act. Certificate of practice 15 An individual who was registered as a registered psychiatric nurse or graduate psychiatric nurse under section 9 of the former Act on the day before this regulation comes into force is deemed to hold a certificate of practice issued under the Act, subject to any restrictions or conditions imposed or attached to the individual's registration under the former Act, until the first renewal date after this regulation comes into force. Investigations and disciplinary actions 16(1) If, on the day this regulation comes into force, the investigation committee under the former Act has directed that an investigation into the conduct of a member or former member be held, the matter must be concluded under the former Act as if the Act had not come into force. 16(2) A matter about which the investigation committee has not directed an investigation be held before this regulation comes into force must be dealt with under the Act. 16(3) A matter that was referred to the discipline committee before this regulation comes into force must be concluded under the former Act as if the Act had not come into force. 16(4) An appeal that was commenced under the former Act but not concluded before this regulation comes into force must be concluded under the former Act as if the Act had not come into force. Transition of authorized prescribers 17 If, on the day before this regulation comes into force, an individual registered under the former Act was permitted to initiate a prescription or order for a drug or vaccine relating to reproductive health, sexually transmitted infections and blood borne pathogens, or diabetes health, that individual may — if they are registered as a psychiatric nurse under the Act, hold a valid certificate of practice under the Act and comply with any practice directions relating to the initiating of such prescriptions or orders — prescribe the drug or vaccine until the earlier of (a) the date that is two years after the day this regulation comes into force; and (b) the date the individual becomes a registered psychiatric nurse (authorized prescriber) under the Act. Coming into force 18 This regulation comes into force on June 1, 2022. SCHEDULE (Section 6) Reserved Act Description 1 Making a diagnosis and communicating it to an individual or their personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care. 2 Ordering or receiving reports of screening or diagnostic tests. 3 Performing a procedure on tissue (a) below the dermis; (b) below the surface of a mucous membrane; (c) on the surface of the cornea; 4 Inserting or removing an instrument or a device, hand or finger (a) into the external ear canal; (b) beyond the point in the nasal passages where they normally narrow; (c) beyond the pharynx; (d) beyond the opening of the urethra; (e) beyond the labia majora; (f) beyond the anal verge; or (g) into an artificial opening in the body. 5 Administering a substance (a) by injection; (b) by inhalation; (c) by mechanical ventilation; (d) by irrigation; (e) by enteral instillation or parenteral instillation; or (f) by transfusion. 6 Prescribing a drug or vaccine. 9 Administering a drug or vaccine by any method. 10 Applying or ordering the application of (a) ultrasound for diagnostic or imaging purposes, including any application of an ultrasound to a fetus; (b) electricity for (iv) defibrillation, (vi) electroconvulsive shock therapy, (x) transcutaneous cardiac pacing; (e) X-rays for diagnostic, imaging or therapeutic purposes. 11 In relation to a therapeutic diet that is administered by enteral instillation or parenteral instillation, (a) selecting ingredients for the diet; or (b) compounding or administering the diet. 13(a) Putting into the external ear canal, up to the eardrum, a substance that is (a) under pressure. 20 Performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality, or the ability to meet the ordinary demands of life.
