Provincial Water Infrastructure Permit Exemptions Regulation, M.R. 61/2023 The Water Resources Administration Act , C.C.S.M. c. W70 Regulation 61/2023 Registered June 9, 2023 bilingual version (HTML) DEFINITIONS Definitions 1 The following definitions apply in this regulation. "Act" means The Water Resources Administration Act . («  Loi  ») "permit" means a permit issued under section 15.2 of the Act. (« permis ») No permit required for certain activities 2(1) If the activity is on, over or across provincial water infrastructure, a person is not required to obtain a permit for the following: (a) installing, operating and maintaining a temporary manure transportation line that forms part of a drag line manure application system, if the system's operation complies with the Livestock Manure and Mortalities Management Regulation , Manitoba Regulation 42/98; (b) installing operating and maintaining a temporary irrigation or water supply line, if the person has the right to use the water being transported; (c) erecting and maintaining temporary or seasonal ice fishing shelters on a frozen water surface. 2(2) A person is exempt from the requirement to obtain a permit under subsection (1) only if the activity does not damage or impair the function of the provincial water infrastructure. Transitional — existing authorizations 3(1) A person who holds an authorization issued by the minister under subsection 14(4) of the Act as it read the date before the coming into force of this regulation may, without a permit, continue to carry out the activities or maintain, use and operate any structures as set out in the authorization, subject to any terms of conditions of the authorization. 3(2) If a person referred to in subsection (1) wants to make any change to an authorization or if it expires, the person must apply to the minister for a permit. Coming into force 4 This regulation comes into force on the same day that section 1 of The Water Resources Administration Amendment Act , S.M. 2021, c. 29, comes into force.
