This regulation sets labour-condition rules for clothing suppliers to government and requires minimum fair labour practices for covered goods.

G90 Regulation 65/2009 Registered March 31, 2009 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Government Purchases Act . («  Loi  ») "minimum fair labour practices" means the rules set out in section 3. (« pratiques équitables minimales en matière de travail ») Application of responsible manufacturer policy 2 For the purpose of subsection 7(2) of the Act, persons bidding to supply clothing, including uniforms and outerwear, to the government must establish that the goods have been or will be produced in accordance with the minimum fair labour practices. Minimum fair labour practices 3 Goods that are subject to the responsible manufacturer policy must be produced in accordance with the following rules: 1. No forced labour may be involved in the production of the goods. 2. No children under 16 years of age may perform any work involved in the production of the goods that is hazardous or unsafe. 3. Workers involved in the production of the goods must have the right to join or form a trade union and bargain collectively. 4. The goods must be produced in a safe and hygienic workplace. 5. Subject to good faith occupational requirements, the goods must be produced in a workplace where there is no discrimination on the basis of race, religion, age, sex or other similar grounds. 6. All employers involved in the production of the goods must comply with all applicable employment standards legislation in place in the jurisdiction where the goods are produced, including legislation regarding the minimum age of workers, hours and conditions of work and minimum rates of pay. Exceptions to responsible manufacturer policy 4(1) The responsible manufacturer policy does not apply (a) to a contract involving the purchase of goods, where the total value of the goods is less than $5,000; (b) to the purchase of goods required to respond to an emergency; (c) if reasonable efforts to identify a supplier who can supply goods in accordance with the minimum fair labour practices and who is prepared to supply the goods in question have failed; or (d) if the General Purchasing Agent determines that it would not be in the best interests of the government to apply the policy due to concerns about the price of the goods, the ability of the supplier to provide the goods in a timely fashion or the quality of the goods in question. Interpretation 4(2) In this section, "goods" means any item set out in section 2 that is subject to the responsible manufacturer policy. Coming into force 5 This regulation comes into force on the same day that The Government Purchases Amendment Act (Responsible Manufacturing) , S.M. 2007, c. 16, comes into force.
