"Act" means The Education Administration Act . («  Loi  ») "clinician" means a person certified as a clinician under the regulations to the Act. (« spécialiste ») "competence standards" means the standards set out in the Schedule to this regulation. (« normes d'aptitude ») "program" means a program as defined in subsection 1(1) of The Public Schools Act . (« programme ») Teacher competence standards 2 A teacher must meet the competence standards in order to be issued and maintain their teaching certificate. Interpretation — professional misconduct 3 The competence standards must not be interpreted as limiting the generality of the definition "professional misconduct" in section 8.1 of the Act and are made in addition to and not in substitution for or in derogation of the application of that definition or any regulation that prescribes conduct that constitutes professional misconduct under clause (c) of that definition. Application — clinicians 4(1) For certainty, the competence standards apply, with necessary changes, to a clinician in addition to and not in substitution for or in derogation of any enactment regulating the standards of practice of the clinician. Commissioner discretion 4(2) The commissioner appointed under section 8.2 of the Act is to use discretion when applying the competence standards to a clinician in order to account for occupational differences between teachers and clinicians. Coming into force 5 This regulation comes into force on September 2, 2025. SCHEDULE (Section 1)
